c. Chief Code Enforcement Officer shall provide a report to the City Council and <br /> after hearing the matter the City Council may grant or reject the issuance of a <br /> permit. (Ord. 1176, 11-25-1996) (Ord. 1287, 8-4-2003) <br /> G. Home Occupations: <br /> 1. Purpose: The purpose of the home occupation regulations is to provide an <br /> opportunity for home occupations, while ensuring that such home occupations do not <br /> have an adverse impact on the character and livability of the surrounding <br /> neighborhood. The home occupation regulations also ensure that the home <br /> occupation is secondary and subordinate to the principal residential use of the <br /> property. <br /> 2. Standards: Home occupations shall be subject to the following standards: <br /> a. Home occupations shall only be conducted by the resident of the dwelling, and <br /> within the principal residential structure or dwelling. Not more than 30% of the <br /> floor area of the dwelling, to a maximum of 600 square feet, may be used for such <br /> purposes. The home occupation shall be conducted entirely within the dwelling. <br /> An accessory building shall not be used to operate a home occupation. <br /> b. Only the resident owner(s) or tenant(s) of the dwelling, and not more than one <br /> nonresident employee or full-time equivalent (FTE), shall be engaged in the <br /> conduct of the home occupation on the premises at any time. For purposes of this <br /> provision, "nonresident employee" shall include an employee, business partner, <br /> independent contractor, or other person affiliated with the home occupation who <br /> visits or works at the site as part of the home occupation. <br /> c. The home occupation shall be clearly incidental and secondary to the use of the <br /> dwelling for residential purposes. Exterior alterations or modifications that change <br /> the residential character or appearance of the dwelling to allow exterior business <br /> identity shall not be allowed. Interior alterations or modifications that eliminate <br /> the kitchen, living room, any of the bedrooms or bathrooms of the dwelling shall <br /> not be allowed. <br /> d. There shall be no exterior display or storage of equipment or materials used in <br /> the operation of the home occupation. <br /> e. The required off-street parking for the residential use shall not be reduced or <br /> made unusable by the home occupation. The home occupation shall have a <br /> maximum of two additional vehicles to be parked on or near the property at any <br /> one time. <br /> f. Shipment or delivery of products, merchandise or supplies shall be by single <br /> rear axle straight trucks or similar delivery vehicles normally used to serve <br /> residential neighborhoods. <br /> g. Signage for the home occupation shall be subject to the requirements of <br /> subsection 1010.05A1 (chart) of this Title. (Ord 1349, 5-21-2007) (Ord. 1359, 1- <br /> 28-2008) <br /> h. The operation of the home occupation, as it is apparent to adjacent residential <br /> uses and including the movement of business vehicles, shall begin no earlier than <br /> 8:00 A.M. and end no later than 8:00 P.M. <br /> i. There shall be no indication of offensive odors, noise, vibration, dust, or heat <br /> beyond the boundaries of the residential lot occupied by the home occupation. <br /> j. The following activities shall be prohibited as home occupations: <br /> (1) The operation of any wholesale or retail business unless it is conducted <br /> entirely by mail and does not involve the sale, shipment or delivery of <br /> merchandise on the premises.
