Attachment A <br />LAKE BENNETT PUBLIC FISHING PIER <br />:AND, USE, OPERATIONS AND MAINTENANCE COOPERATIVE AGREEMENT <br />BETWEEN <br />TYE STATE OF MINNESOTA AND THE CITY OF ROSEVILLE <br />This Agreement,,, between the State of Minnesota, acting by and through the Commissioner of the Department <br />of Natural Resources, hereinafter referred to as the "State" and the City of Roseville hereinafter referred to as <br />the "City"., <br />a. The State, wil�l encumber fu�n�ds for the facythrough the standard in�ternal purchasing process <br />9 <br />inclu�din, but not limited to, a separa e <br />te requisition rque <br />g st. <br />The State shall provide technical expertise and equipment, when feasible, assistance with the <br />removal of the old pier and installation of the n�ew, Fishing Pier. The State,, reserves the option to <br />salvage and reuse sections or parts, of'the old pier. <br />c. The State will! provide and install the appropriate signage, for the sitei which indicates that the <br />City and the Department of Natural Resources cooperatively provided the Fishing Pieri. <br />d. The State sh�al�l retain ownership of the Fishing Pier and retains the authority to relocate and/or <br />re move the Fish 1 ng P le ri ifth e Silte "Is, d etile rrn i ned to be i n a d eq u ate o r if t h e City fa i'l s to co m p ly <br />with the terms of the Agreement. Before such removal oir relocation,i the State shall work with <br />the City for a mu�tu�a�ll�y agreed u�pion resolutiono <br />e. The State shall assistthe City with major structural repairs subject1to the availabilltyof funding <br />according to the provisions of Article Ill. <br />f. The State reserves the right to inspect the premises at all times to ibsure that the Oty is in <br />compl�iance with the terms of this A,greem�en�t. <br />
