Attachment A <br />42 <br />storm water management system and the design and engineering for grading, drainage and <br />43 <br />sidewalk as provided in the LCDA Grant Agreement. <br />44 <br />2. <br />Pay cost overages for the oft site, grant-funded improvements if the cost exceeds $,52,432. <br />45 <br />3. <br />Comply with all applicable state and federal laws and the agreement entered into by the City <br />46 <br />of Roseville and the Metropolitan Council specific to the LCDA grant. <br />47 <br />4. <br />Require contractors and subcontractors performing work covered by the LCDA grant to <br />48 <br />obtain all required permits, licenses and certifications, and comply with all state and federal <br />49 <br />Occupational Safety and Health Act regulations, especially the federal Hazardous Waste <br />50 <br />Operations and Emergency Response standards under Code of Federal Regulations, title 29, <br />51 <br />sections 1910.120 and 1926.65. <br />52 <br />5. <br />Prepare payment request forms and provide all back up documentation as required by the <br />53 <br />Metropolitan Council for the onsite grant-funded activities and submit the documentation to <br />54 <br />the City. The Developer must demonstrate that the grant-funded activities have been <br />55 <br />completed and that the contractor has received payment for this work. <br />56 <br />6. <br />Be responsible for the completion of the project described in the grant application within the <br />57 <br />two-year grant period. <br />58 <br />7. <br />Submit a written explanation to the City if the grant funds for onsite improvements cannot be <br />59 <br />expended within the timeframe of the grant agreement. <br />60 <br />8. <br />If a grant extension is required,, request a grant extension at least 100 days before the <br />61 <br />expiration of the grant agreement. <br />62 <br />9. <br />Provide necessary information to the City to complete the LCDA grant annual report, final <br />63 <br />report, and certificate of expenditures,, pursuant to Metropolitan Council requirements for <br />64 <br />onsite grant funded activities for submittal by the City, as well as all other certificates, <br />65 <br />information,, reports and documents which are necessary for the City to comply with the <br />66 <br />requirements of the LCDA grant. <br />67 <br />10. <br />If requesting the conversion of the grant to a loan, pay for all attorney fees associated with <br />68 <br />loan document review and all other costs incurred by the City to convert the grant to a loan. <br />69 <br />11. <br />Comply with all terms and conditions of the grant and use the grant funds in the manner and <br />70 <br />only for such purposes as are set forth in the grant. <br />71 <br />12. <br />Provide such additional information and documentation as the City may request from time to <br />72 <br />time to enable the City to comply with the terms and conditions of the grant. <br />73 <br />ON <br />
