18 4.0 REVIEW OF REQUEST <br />19 <br />4.1 Both of the parcels have a zoning designation of LDR-1, Low Density Single Family <br />20 Residential District and a Comprehensive Land Use Plan designation of LR, Low Density <br />21 Residential. <br />22 4.2 The proposal seeks to add a roughly 30 foot deep by 60 foot long piece of land contained <br />2'3 on the adjacent 1.5 acre parcel which abuts the rear yard of the 544 Ryan Avenue <br />24 property. Both parcels are under the control of the Trust and the Recombination is being <br />25 has been sought by the individuals who have a purchase agreement for the 544 Ryan <br />26 property- <br />2 7, 4.3 The proposed change in land area generally has no effect. The 544 Ryan property does <br />28 get larger and increases the size to become compliant with the minimum size <br />29 requirements of the City Code or specifically going from 10,440 sq. ft. to 12,240 sq. ft. <br />'30 The larger parcel loses 1,800 sq. ft. in an area and a shape that most likely would not <br />impact any future land division should the property owner desire in the future to <br />'32 subdivide the parcel <br />' '3 5. 0 STAFF COMMENTS <br />34 5.1 City Code § I 104.04B (R.ecombination) allows the transfer of property from one parcel to <br />'35 an abutting parcel upon the approval of the City Council. No public hearing is required <br />provided that the proposed recombination does not cause any nonconforming condition <br />N3 7' on the properties involved. <br />' 8 5.2 The proposed recombination would not create any new nonconforming conditions nor <br />'N39 exacerbate any existing nonconformities. On the contrary, the proposed inclusion of <br />40 <br />1 800 sq. ft. to the 544 Ryan property created a fully conforming property. <br />41 5.3 If approved, the proposed recombination would have no effect on the surrounding <br />42 properties. <br />4'3 5.4 Drainage easements consistent with Code requirements must be indicated on the final <br />14-14, survey submitted for City Staff review and approval. <br />45 6.0 STAFF RECOMMENDATION <br />46 6.1 Based on the comments and findings outlined in Sections 4 and 5 of this report,, the <br />4 7' Planning Division recommends approval of the requested RECOMBINATION MINOR <br />148 SUBDIVISION to allow the proposed addition of an approximate 30 foot by 60 foot <br />149 piece of land to 544 Ryan Avenue, subject to the following conditions.- <br />50 a.
