<br />2. The Borrower warrants, covenants and represents that, to the best of the
<br />Borrower's knowledge after due, inquiry and except as may be lawfully
<br />maintained and utilized, there does not exist 'in or under the real property
<br />described in Exhibit "A" attached hereto and made a part hereof and the
<br />improvements thereon (hereinafter together called the ''Preeraises" , any pollutant,
<br />toxic or hazardous waste or substance, or any other material the release or
<br />disposal of which is regulated by any law, regulation, ordinance or code related to
<br />pollution or environmental contamination and,, that no part of the Premises was
<br />ever used as a dump or sanitary landfill, and that there exists on the Premises no
<br />storage tanks, electrical transformers or other equipment containing P' CBs or
<br />asbestos. The Borrower represents that the Borrower has rieceived no, �siummons,
<br />citations, directives, letters or other c o mmuni cati lolls written or oral,i from any
<br />federal, state or local agency or department concerning the storing,, releasing,

<br />pumping, pouring, emitting,, ernp ing or dumping of' any pollutant, tox"

<br />3. The Borrower covenants that the Borrower shall not, nor shall the Borrower
<br />permit others to, use the Premises in violation of law for the business of
<br />generating, transporting, storing, treating or disposing of any piollutant,l toxic or
<br />hazardous waste or substance nor shall the Borrower, either take or fall to take any
<br />action which may result in a release, ofiany haziarldoluis substance, from or, to the
<br />best of the Borrower's ability, onto the Premises in violation of law.
<br />4. The Borrower agrees to indemnify and to hold Premier Bank, a Minnesota
<br />corporation, its successors and assigns (the "Lender"') harmless from any and all
<br />claims, causes of action, damages, penalties, and costs (including, but not limited
