51 RESOLUTION AUTHORIZING THE ACQUISITION 52 OF CERTAIN PROPERTY FOR PUBLIC USE 53 BY RIGHT OF EMINENT DOMAIN 54 0 55 WHEREAS,, the City of municipal Roseville is a micipal corporation orgaiiized and exi'sting 56 pursuant to the Constitution and laws of the State of Minnesota and its charter arid is Lyovcrned 57 by the City Council (the "Council"); 58 WHEREAS, the City, has established Development District No. I (the "Project Area") 59 under the authority of Minnesota Statutes, Chapter 4169 (the "Act"') and 'in particular sections 160 4169.058, 469.082 and 4169-124 through 469.134 thereof, and in accordance with the provisions of 61 this Agreement, and subject to all applicable requirements of the Act, has established a Tax 62 Increment Financ,'n I I I I I g Dstrb'd (the "Tax Increment Dlstdct") with*n the Project Area and adopted 63 'a Tax Increment Financing Plan (the "Tax Increment Plan") for the Tax Increment District to 64 facilitate the financing of public development and redevelopment costs in the Project Ayea!, 165 WHEREAS,, the City deems 'it to be in the public interest to facilitate and encourage 166 redevelopment of the, Project Axe a by a combination of public and private activity witbin the 167 Prof eat Area and in accordance with the Tax Increment Plan', 68 VMEREAS, Opus Northwest, LLC ("*Developer"') has proposed an office development 619 (hereinafter defined as the "Project") within such Project Area which the City believes Will 70 promote and carry out the objectives for which redevelopment 'is undertaken, will be in the vital 71 best 'Interests of the City, will promote the health, safety, morals, and welfare of 'Its residents. and 72 wil"ll be in accordance with the public purposes and provisions of the applicable state and local 73 laws and requirements under which activities witbin the Project Ayes have been undertaken and 74 are being assilsted; 3
