A copy of the aniended ordinance is enclosed for your review. Please note on page one of the local ordinance, where mininIU111 penalties are stipulated. On October, 28, 200811, an employee, Christian Olson, of your establishment sold an alcoholic beverage to a minor in violation of the attached ordinance. Our records indicate that the employee of your establi,shment did. participate in. a city approved optional manager and sieverier training program., City records also indicate your establishment had two preVIOLIS violations in the past thirty-six (36) months, December 2005, and Aug-List 2007. Therefore, pttrsuant to Section 'r.1.. 5 of the Roseville. City Code, the presumpti ve penalty for a third violation for on-sale license holders who did participate in the optional manager and server training is a minimum penalty of a $500.00 firie and a three (3) day suspension. When a violation occurs, the pollee department provides inforniation to the City Council which either will assess the presumptive penalty set forth above or depart up -ward or downward based on extenuating or aggravating circumstances. The information set fortl in this letter regarding the failed compliance check will be passed on to the City Council, as well as iD.forrnation regarding YOUr partIcipation in the optional manager and server training program,, and the history of compliance checks at your establishment.
