Department Approval <br />l <br />REQUEST FOR COUNCIL ACTION <br />City Manager Approval <br />Item Description.- Set Public Hearing for an Ordinance relating to <br />Electronic Auction of Unclaimed Property <br />=96, 1 <br />2 Minnesota Statute 471.195 provides that, "Any city may by ordinance pro videfor the custody and <br />3 disposal ofpropeery lawfully co ing into its possession in the course ofmuni ciph l operations and <br />4 remaining unclaimed by the owner. Such ordinance m'ay pro vide for the sale of such property to the <br />5 highest bidder at public auction... To allow the police department the means to dispose of -through <br />6 public auction--the sale of confiscated, recovered, and found items whose owners could not be <br />"7 identified or located,, the City adopted Ordinance 849.- Sale of Unclaimed Pro <br />9 The police department has been disposing of unclaimed property from its property room for ten plus <br />I ('_) years through the use of local-only, public auctioneering firms. Monies earned from these auctions are <br />"I'll credited to the City's general fund. While the use of local, public auctioneering firms has proven <br />12 somewhat beneficial,, several local law enforcement agencies are now utilizing Prop ertyRo om. com, <br />13 Inc.,, an online public auction company that has consistently auctioned items at a much higher sales rate <br />14 than local-only auctioneers; therefore, generating more income for the municipality or county. <br />16 City Code Sesction 508.01.- Sales of Unclaimed Property, currently reads, "The (7hief of Police is <br />I 7 authorized to administer the disposal pr perry lawfully co in into the possession of the (., Y ity and <br />I remaining unclaimed by the owner after sixty (60) days.
