It is based on <br />the facts and information availiablue to the Commissioner as described <br />below.- All public data the Commissloner relied upon to issue this <br />opinion are available for public 'inspection and copying at the office of <br />the Information Policy Analysis. Dlilvision (IPAD), unless the data have <br />been disposed of in compliance with the state Record's Management <br />Act. <br />Facts and Procedural Histiory: <br />On March 10, 2005, 1PAD received a lette.r,, dated March 3, 2005, from <br />Shirley Workman. In her liette Ms. Workman asked the Commissioner to <br />iissu�e an advisory opinion reigiarding public access to meetings of <br />committees of the Cannon. Falls Community Hospital Board (the Board). Ms. <br />Workman submiltited the $200�.00 fee required by section 13.072, <br />On March 14, 2005, IPA wrlote to Glenn Christian., interim chief executive <br />officeir of the Cannon Falls Hospital. In its letter, IPA D informed Mr. <br />Christian of Ms. Workman's request and gave the Board, or any of its <br />mem�bers, an opportunity to explain the Board's position. The Board <br />presented its position in a le�tter, dated March 23, 2005, from its- attorney., <br />John E. Diehl,, <br />A summary of the facts presented by Ms. Workman is as follows. <br />The Board has five members and has a number of standing committees. <br />Two members of the Board sit on these standing committees. The <br />committees meet regularly to discuss and consider matters pending before <br />the Board. In most cases the, meetings are closed to the public. Ms. <br />Workman stated that when a committee has considered an issue, there is <br />little, discusslon of that Issue by the Board. <br />Ms., Workman provided a copy of 'a February 22, 2005, letter from Mr. Diehl <br />to Mr. Christian discussing whether the committee meetings were subject to <br />the Open Meeting Law, Minnesoita Statutes,, Chapter 13D (OML), and so <br />needed to be open to the public.
