lls1Spvq+-J� <br />REQUEST FOR COUNCIL ACTION <br />Department Approval <br />.- <br />Date.- 6/30/08 <br />Item No..- 12.41 <br />City Manager Approval <br />Item Description.- Discuss Request by Kron Family for City Participation in Sanitary Sewer <br />Service Repair <br />I BACKGROUND <br />2 Bill and Anna Iron, who reside at 1221 West County Road B, have had ongoing problems with <br />3 their sanitary sewer service since they purchased the home over 5 years ago. The problems <br />4 worsened to a point where in February of 2007, they had to hire a contractor to dig and repair <br />5 their service line under the street. Shortly after the repair was completed, the Iron's sent a letter <br />6 to the City requesting some level of participation in the costs (See Attachment A)'. The Iron's <br />"7 also have corresponded with the Council on this matter and are seeking a determination <br />8 (Attachment B). <br />9 <br />10 We do receive several of these requests each year. The City Attorney has advised staff that the <br />"I'll City Code does not provide authority for participating in private lateral repairs other than those <br />12 which are determined caused by city actions or it contractors actions. In these circumstances <br />13 staff would document the specific cause or reason for city liability. <br />14 <br />15 POLICY OBJECTIVE <br />16 It is our policy to provide excellent customer service and cost effective and efficient programs <br />I 7 and services to the residents of the city. City Code dictates that ownership and maintenance of <br />I service laterals lie with the property owner. (Attachment C), The City of Roseville constructed the <br />19 majority of the sewer mains in the late 50's and early 60's. The city maintains the mainlines. The <br />2 ('-) City has only participated in repair of private sewer laterals in cases where the city's contractor <br />2 1 had caused damage to the line or in extremely unusual circumstances. <br />22 <br />23 FINANCIAL IMPACTS <br />24 There are potentially significant cost impacts to a policy or code change allowing city <br />25 participation in private sewer lateral repairs. The majority of properties throughout the city <br />26 connect to utilities within the road right-of-way and most are under the pavement itself Utility <br />27 rates would need to be adjusted significantly if major shifts in policy were implemented. Typical <br />28 repair of a sanitary sewer service lateral can vary from $,3,000 to $,5,000 although some may be <br />29 considerably higher due to individual site conditions. There are approximately 10,000 <br />3 ('-) connections to the sewer system in Roseville. <br />Page I of 2 <br />
