BACKGROUND. The Owner is the fee owner of certain real property located in <br />the City of Roseville, County of Ramsey, State of Minnesota, legally described as <br />follows.- <br />That part of the Northerly 3/4 of the Northwesterly 1/4 of Section 17 Township 29 Range <br />23 located Easterly of Highway 280 & excluding the plat of FAIRWAYS SUB <br />Hereinafter called "Subject property"'. The subject property is located south of <br />County Road B and east of Fulham Street right- of- way. <br />The Owner has experienced damage to the subject property as a result of people <br />trespassing on the subject property and would like to restrict access by <br />constructing a fence along all public rights- of- way. The fence along the east side <br />of the Fulham Street right- of- way would encroach into the Fulham Street right- <br />of- way. This agreement also covers a cart path that is located within this right- <br />of- way. See Attachment A for location offence in relationship to the right- of- <br />way. <br />2. ENCROACHMENT AUTHORIZATION. The City hereby approves the <br />encroachment on its right- of- way for the construction and maintenance of a <br />fence and cart path.
