RCA—Financial Crimes Services (FCS)I <br />Page 4 of 8 <br />1 <br />2 B. City Attorney and Police designees will conduct as needed meetings with key FCS staff to offer <br />3 procedural guidance, evaluate program performance, and provide support and direction. <br />4 <br />5 C. City Attorney and Police Department shall implement departmental policies that are consistent with <br />6 the fulfillment of the terms of this Agreement. <br />7 <br />8 D. Police designee shall support FCS in reviewing checks received in the program daily that are posted <br />9 on the web site. <br />10 <br />11 6. Performance Aareement - FCS agrees to provide the following professional services to the City of Roseville <br />12 in a timely and efficient manner. FCS will provide the following level of administrative services and <br />13 offender education classes.- <br />14 <br />15 A. Perform daily operations and management of all clerical and accounting functions related to offenders <br />16 of NSF checks to be included in the Roseville Worthless Check Program. <br />17 B. Generation of demand notices to worthless check writers,, and follow through with respect to the <br />18 collection and disbursement of victim restitution,, administrative fees,, and FCS education training class fees. <br />19 C. Provide necessary correspondence and follow-up telephone inquiries to victims and offenders. <br />20 D. Properly maintain all physical files, financial records, documentation,, reports,, computer files, etc. for <br />21 a period of no more than eight (8), years. <br />22 E. Provide voluntary (unless mandated by state statutes), worthless check offender financial management <br />23 education classes. <br />24 F. Conduct classes designed to teach and provide meaningful information and lessons to offenders on <br />25 criminal consequences of Property Crimes, as well as focus on personal management. <br />26 G. Scheduling of all classes. The training will require 4 hours of class time. Sessions will be held in the <br />27 City of Roseville and/or surrounding cities. These training sessions may be jointly held with other metro <br />28 communities. Class size to not exceed 45 attendees. <br />29 H. Maintain records of offenders making restitution,, payment of fees, attendance records of offenders <br />30 completing as well as failing to attend the training session. <br />31 I. Maintain records of payment to the victims and City of Roseville fees on a monthly basis. <br />32 J. Provide reports to the City of Roseville; annual, quarterly, monthly financial revenues, completed <br />33 offender classes,, and related reports as required by the City and law enforcement. <br />34 K. Offenders who refuse to enroll into the program or fail to complete the program will be reported to <br />35 the City of Roseville for prosecution. <br />36 <br />37 7. Program Operational FeeslRevenue: <br />38 <br />39 A. Victim -1 The victim will be reimbursed any money recovered from the offender. <br />4O <br />41 B. Check Diversion will be governed by <br />4 1. Minnesota Statutes,, section 604.113 subdivision 2, paragraph (a), allows for the collection of <br />43 a service charge on dishonored checks with a not to exceed value of $,30.00. <br />44 2. Minnesota Statute 609.535 <br />45 3. A fee of $,20.00 will be assessed to an offender who fails to appear at education class and has <br />4 to re-schedule for the class. This fee will be assessed each time the offender has to re- <br />47 schedule. This may occur up to three (3), times before referring the offender to the Police as <br />48 failing to appear. <br />
