T'here are two types, of spelcial elections that the city may <br />I'leigally conduct: 1) a special election to fill a vacancy in an elected city office an <br />2 x <br />) a special election to place a question before the voters. <br />Special ellectilions to fill vacancies, in elected c1ty offices are authorized by Minn. <br />Stat. § 412,02if subd. 2a. Special elections are required to fill a. vacancy that <br />occurs before the first day to file for officel when there are more than two years <br />remag on the term to which the person vacating the offi,ce was elected. These <br />special elections �must be held at or before the next city general election, <br />Adiditlionally, the city council may- enact an ordinance authorizing special elections <br />to fil'! vacancies, that occur at different times or to conduct a special election that <br />would occur on a, date other than that of' the next clity general election. <br />,Special electi"ons to place questions or, ihe ballo"E' are authorized by Minn. S4at. <br />L <br />2051.10, subd 1. These special elections may occur on the action of the city <br />clouncil or upon receipt of a petition from city, vioters and must be on questions on <br />which, the voters are authorized by law to pass judgment. Hence, advisory <br />referenda are, not permitted under M'innesota law. <br />This office has a policy of recommending to the governing bodies of the <br />municipalities and school districts in the county that all special elections be held <br />concurrently with the state general election (in evein�-numbered years) or on the <br />date of the, city and school district general elections in odd-numbered years.) <br />There are several reasons for this policy., <br />First, we believe that elections should be icond�ucted in a manner that permits the <br />ina�ximum amou�nt of voter participation.
