Costs will be reported to Council following the <br />26 abatement. <br />27 However,, the Nellessen's have requested that the City help pay a portion of the repair costs contending <br />28 the City should have provided them with sewer service by gravity feed when the City main was <br />29 installed back in the 196(x's,, and/or,, allow them to repay the charges over a five year period. A copy of <br />3 ('_) their request is attached. <br />3 'i At the time of this sanitary sewer installation, Mr. Nellessen contacted the Village Engineer with <br />32 concerns about not having basement sewer drainage. The consulting engineer, Roger Short, Banister <br />33 Engineering, responded to Mr. Nellessen's concerns with the attached letter dated June 13, 196 1. <br />34 The letter states that at least 4 homes did not receive full basement drainage. There were also <br />35 unimproved properties that did not get regular or full service. <br />36 "The reason for that was that the sewer would have to have been considerably deepened for a long <br />37 distance for all of these homes,, and this was not considered to be economically feasible under the <br />3,',i circumstances of the use of the land."' The letter goes on to state that "it has been the previous policy of <br />39 the Village or Roseville to make a partial or approximately one-half assessment against properties <br />4�,,:-)� receiving only first floor drain."' <br />4 'i At the Public Hearing held on October 7, 196 1, Mr. Nellessen objected to the assessment. The <br />42 resolution amending assessments for sanitary sewer improvement No. 3, show that Mr. Nellessen <br />43 received a reduction in his assessment amount in consideration for not receiving basement drainage. <br />lrvlr% <br />44 Mr. Nellessen installed an ejector station to provide his home basement drainarn�-,. <br />45 City Code dictates that ownership and maintenance of service laterals lie with the property owner. The <br />46 city maintains the trunk utility lines. The City has only participated in repair of private sewer laterals in <br />47 cases where the city's contractor had caused damage to the line or in extremely unusual circumstances <br />4,', where original design considerations did not consider replacement implications on the homeowner. <br />49 Public Works staff does not feel that either of these circumstances apply in this instance, since in 1961, <br />the City reduced Mr. Nellessen's assessment in consideration of not receiving basement drainage. <br />STAFF RECOMMENDATION <br />52 Staff recommends that the Council direct Community Development staff to abate the above referenced <br />53 public nuisance violation located at 411 Owasso Boulevard South and to assess the charges over a five <br />54 year period at an interest rate determined by the Finance Director. <br />55 REQUESTED COUNCIL ACTION <br />6 Direct Community Development staff to abate the above referenced public nuisance violation at 411 <br />"7 Owasso Boulevard South by hiring a general contractor to repair or replace the sewage holding tank. <br />58 The property owner will then be billed for actual and administrative costs.
