Stat. § 462.,3 52 defines a "comprehensive plan" as a "co, mpilation of policy
statements, goals,, standards and maps for gui.ding ... development.... '", As the statute indicates,,
a comprehensive plan typically includes "a land use plan, a community facilities plan, a
transportation plan, and recommendations for plan execution." The statute does not indicate,
however,, that a. comprehensive plan is limited to the above components.
Given the statutory language, the short answer to your question is that it would, in illy
opinion, i not be inconsistent with the law to incorporate a master plan into a comprehensive
Plan. The larger question, however, involves the appropriateness, from a policy perspective, of
doing, so, and the consequences resulfing fi•om inclusion,
As you are aware, Minn. Stat. § 462.353, provides that adopti.on or amendment of a
comprehensive plan requires a 2/3 vote of all members of the Council. As you also know, in
FOTL v. City off'. ill , 2006 WL 2347879, the Court of Appeals indicated that if master
plans are 'incorporated into a comprehensive plan, the master plans themselves can only be
amended by the 2/3 vote mentioned above.
730 Second Avenue SIOLIth, Suite, 300, Minnezipolis, MN 55402 a p (612-) 3319-0060 e f (612) 339-0038 * wwwratwiklaw.com
Paul C.
