<br />This letter, follows upon our discussions relative to the issue of whether master plans
<br />irlay or should be adopted by reference into the City' si Comprehensive Plan.
<br />Minn,.. Stat. § 462.,3 52 defines a "comprehensive plan" as a "co, mpilation of policy
<br />statements, goals,, standards and maps for gui.ding ... development.... '", As the statute indicates,,
<br />a comprehensive plan typically includes "a land use plan, a community facilities plan, a
<br />transportation plan, and recommendations for plan execution." The statute does not indicate,
<br />however,, that a. comprehensive plan is limited to the above components.
<br />Given the statutory language, the short answer to your question is that it would, in illy
<br />opinion, i not be inconsistent with the law to incorporate a master plan into a comprehensive
<br />Plan. The larger question, however, involves the appropriateness, from a policy perspective, of
<br />doing, so, and the consequences resulfing fi•om inclusion,
<br />As you are aware, Minn. Stat. § 462.353, provides that adopti.on or amendment of a
<br />comprehensive plan requires a 2/3 vote of all members of the Council. As you also know, in
<br />FOTL v. City off'. ill , 2006 WL 2347879, the Court of Appeals indicated that if master
<br />plans are 'incorporated into a comprehensive plan, the master plans themselves can only be
<br />amended by the 2/3 vote mentioned above.
