<br />of the culrre'n�t pre'l�iimmiin�ary plat) iin�to a park and ride faciil�iity, re'q�uIiiriin approval of a

<br />re'viie'w of the e'ase'mme'nt vacatiion�, Mr. Paschke noted re'ce'iipt of the legal opiin�iion�
<br />by the Ciity Attorney, dated Se'pte'mmbe'r 2, 2008, proviide'd as a bench handout,
<br />and made part of the record attached hereto and made a part thereof, and
<br />providing re'corde'd doculmne'ntatiion that the Ciity holds QuIiit Claim De'e'ds for the
<br />north�e'rn te'n foot (10") wide se'ctiionn of Lot 3,0 and Lot 1, Block B jwin Viie'w) and
<br />the e'aste'rn te'n foot (10") wide portiion of Lots 1, 2, and 3,, Block B jwin Viie'w);
<br />with n�o e'ase'rme'nt iin evidence to be vacated, as pre'viiou�sl r re'q�ule'ste'd by the

<br />re'viise'd conditions, for the record, were proviide'd as a bench h�an�doult at the
<br />mme'e'tiin g, made part of the record, and attached hereto and made a part
<br />thereof. Mr. Paschke re'viie'we'd the ne'ce'ssary shifting of the plat, base'd on th�iis
<br />ne'w iinformmatiion and Quliit Claim De'e'ds ve'rsuls e'ase'mme'nt vacatiion�s. Mr. Paschke
<br />adviise'd that, wh�e'n the ou�tl�ot its re-platted, the Ciity wou�l�d have rii gh�ts to the
<br />roadway rii gh�t-of-way for Iona Lane and Mount Ridge Road, and will se'e'k to have
