P.A.
This letter follows, up our conversations and e-malls on the above topic. You had
requestied my 'interpretation of existing Code concerning City responsibility for repair of
private utility service lines.
With respect to water service fines, City Code Section 801.67 provides that "It shall be
the responsibility of the consumer or owner to maintain the. service pipe from the water main
into the hom r building."" With. respect to sanitary sewer lines, Code Section 802.0.6(1,,)(2)
p ides, similiarly, that "It shall be the responsibility of'the owner- or occupant to maintain the
pry 1 1,
sewer service frorn the tinain. sewer into the home or building."
As we have discussed, the above Code sections are quite clear, and do not contain any
pro ir fimflnv- lan2unre whch would allow the C' articipate in part in a service line
Visois 0 1 1 1 1 AV to P
repair. if such, langua,ge is desired, the Code sholuld, be amended. Of course, if the City,
through its actions or inactions. might be deerned potentially culpable for damage to a. H
then the City would have authority topay for or contribute to the costs to rectify such darnage.
730, Slecond AvenUe Sl(-)LlLh,, Suite 300.
