I think that would be helpffil in trying to draft this ordinance.,
Thanksl,
Eric
Carotyn Curt],
-- ----------- -
Frorn:
Beets, Neal
Sent:
Wednesday, November 05, 2003 7-129 PM
To:
; sta@ratwiklawcom; 'jts@ratwikIaw.com'
CIS:
Curti, Carolyn
Subject:
Council Request for Ordinance
importance: HIigh
Scott and Jay, the Council adopted a motion at tonight's special meeting directing the City Attorney -to draft an
il
ordinance for discussion at, the November 17th council meeting calling for a special city election as soon as
possible whenever there is a vacancy on the council because a councilmember has been. elected to a higher
ossi
office.
I
The vote, on the motion was 3-,2, with Mayor Kysylyczyn, Counicilmember Schroeder and Counc'lmei -n ber
Kough speaking and voting in favor of the motion as an effort to, get the policy-making process initia tie
d as
soon as possible, that the draft ordinance could. be the subject of public input at the council meetings on 1.1117
,
and 11/24 and possibly later', that the draft ordinance could be amended at any point along the way, that this
,h
process is similar to the bill drafting and public hearing process in the state legislature, that Councilmember
Klausing had spoken in favor of such. an ordinance during his campaign, and that time is of the essence in
getting a special election ordinance enacted since a vacancy on the Council will exist on January 5 and it is
possible this lorldin ance won 11 t apply to that vacancy if the ordinance is not in effect by that date. Councilmernbers
I -'al meeting was called for limited purposes and
Maschka and Klausing voted against the motion, saying this speci
this, *issue was not part of the call for this meeting and was not on the agenda, that the City Attorney was already
preparing a legal opinion on this subject and we ought to wait to see what that opinion says before directing the
City Attorney, to, draft an ordinance, that the motion's direction to the City Attorney is vague, that the motion is
misguided in directing that the draft ordinance establish, a, special election only if a councilmember is elected to
a higher office but not if a councilmember is elected to an equal or lower office -- however those terms might be
defineid,, and that it is preferable to receive public input about the concept and features of a special election
before an ordinance is drafted. ,
P'lease carry out the council's motion directing the drafting of the ordinance described above. Note that in order
i
for the draft ordinance to be placed in the council's packet and, available to the public on our website, that we
would have to receive the draft ordinance from you no later, than noon on Thursday, November 13.
am-=.
11me- -
(Phone) 651-792-7021
(Fax) 615 1 -7'12 -7020
M
