8 6' 5.0 ZONING: <br />87 5.1 The Roseville Planning Commission conducted a duly noticed public hearing on June 6, <br />88 2007 pertaining to the United Properties General Concept Planned Unit Development <br />89 Amendment voting 4- I to deny the submitted request. On June 18, 2007, the Roseville <br />90 City Council approved (3-2) the Preliminary Plan, Rezoning, and General Concept <br />91 Planned Unit Development Amendment. On June 30, 2008 the City Council approved <br />92 the Final Development Planned Unit Development, subject to the DEVELOPER's strict <br />93 compliance with the approved plans, and terms and conditions of this AGREEMENT. <br />9 4 <br />95 5.2 The CITY confirms that the zoning of the subject parcels is as follows.- <br />9 6' <br />97 Planned Unit Development with an underlying zoning of General Residence <br />98 District (R-�3). <br />99 <br />100 5.3 The CITY further agrees to create this zone and overlay district subject to the <br />101 DEVELOPER's strict compliance with the terms and conditions stipulated in Section 9.1 <br />102 through 9.11 of this agreement, all approved plans, and other necessary approvals. <br />103 <br />104 5.4 Minor departures from the approved final development plans, which are consistent with <br />105 this AGREEMENT and the underlying General Residence District zone and/or the <br />106' United Properties PUD may be approved by the CITY's Development Review <br />107 Committee and the Community Development Director or designee, as provided in the <br />108 Roseville City Code (Section 1008). Substantial departures from the approved final <br />109 development plans will require an amendment to the Planned Unit Development in <br />110 accordance with Sections 1004,, 10WP 101 , 101 and 1015 of the Roseville City Code. <br />ill Where not superseded by more restrictive requirements of this PUD, the standards of the <br />112 underlying zone shall apply, as stated in Chapter 1004 of the Roseville City Code. <br />113 Whether an issue is "minor" or "significant" shall be determined by the CITY as defined <br />114 in Section 1008.09 of the City Code. <br />115 <br />116' 6.0 DEVELOPMENT of PROPERTY: <br />117 6.1 <br />The DEVELOPER shall commence and undertake site and structure development <br />118 <br />activities in accordance with the attached plans and maps as identified in Section 4 of this <br />119 <br />AGREEMENT and the terms and conditions identified in Section 8 and 9 of this <br />120 <br />AGREEMENT. <br />121 <br />122 6.2 <br />For purposes of this provision, development activity shall be defined as obtaining a <br />123 <br />building permit, commencing footings and foundations, and continuing with project <br />124 <br />construction on the site. <br />125 <br />12 6' 6.3 <br />Development of the property and installation of public and/or private improvements shall <br />127 <br />be in substantial accordance with all approved plans (attached in this PUD Agreement), <br />128 <br />and/or as approved by the City. <br />129 <br />K <br />
