Draft Resolution Attachment F <br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br />I Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />2 Roseville,, County of Ramsey, Minnesota, was held on the 25 th day of August 2008, at 6.-00 p.m. <br />3 The following members were present.* <br />4 and was absent. <br />5 Council Member introduced the following resolution and moved its adoption <br />6 RESOLUTION NO. <br />"7 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT IN ACCORDANCE <br />WITH §1005.015 AND §1013.01 OF THE ROSEVILLE CITY CODE FOR ROSEVILLE <br />9 PROPERTIES AT 2575 FAIRVIEW AVENUE (IMF 08-�031) <br />WHEREAS Roseville Properties owns the property at 2575 Fairview Avenue; and <br />p I <br />WHEREAS,, the subject property is legally described as. <br />12 Rosedale Industrial Park Lot 3 Block 1 <br />13 PIN: 09-29-2 3-21-0009 <br />14 WHEREAS,, through the applicant, Allen Lenz,, the property owners seek to allow a <br />motor vehicle dealer,, which is a conditionally permitted use in the applicable General Business <br />16 Zoning District; and <br />I 7 WHEREAS,, The Roseville Planning Commission held the public hearing regarding the <br />I requested CONDITIONAL USE PERMIT, voting 7-0 to recommend approval of the request <br />19 based the comments and findings of the staff report dated August 6, 2008; and <br />20 WHEREAS,, the Roseville City Council has determined that approval of the requested <br />2 1 CONDITIONAL USE PERMIT will not adversely affect conditions on, or value of, nearby <br />22 properties and will not compromise the health, safety, and general welfare of the citizens of <br />23 Roseville; <br />24 NOW THEREFORE BE IT RESOLVED,, by the Roseville City Council, to APPROVE <br />25 the request for a CONDITIONAL USE PERMIT in accordance with Section § 1013.01 of the <br />26 Roseville City Code, <br />27 a. Motor vehicles sold shall be those that require state registration, license plate, and <br />28 driver's license,, and shall be further limited to neighborhood electric vehicles as <br />29 defined in MN Stat. 169. 01 subd. 91 , motorized bicycles as defined in MN Stat. <br />30 169.01 subd. 4�a,, electric- assisted bicycles as defined in MN Stat. 169.01 subd. 4�b, <br />3 1 and motorcycles as defined in MN Stat. 169.01 subd. 4 which nominally do not <br />32 exceed 25 0c of piston displacement capacity; <br />33 b.
