Department Approval <br />Item No..- 7.e <br />Manager Reviewed <br />Description: Establish a Public Hearing to Consider an Off-Sale Liquor License for <br />Snelling Liquors located at 2217 Snelling Avenue. <br />Background <br />Snelling Liquors has applied for an Off-Sale and Intoxicating liquor license at 2217 Snelling <br />Avenue. The applicant recently received a conditional use permit to operate a liquor store at this <br />location. The City Attorney will review the application prior to the issuance of the license to ensure <br />that it is in order. A representative from Snelling Liquors has been invited to attend the hearing to <br />answer any questions the Council may have. <br />The City currently has 9 Off-Sale liquor Intoxicating licenses issued. Per current City Code, a <br />maximum of 10 Off-Sale Intoxicating liquor licenses are allowed. If granted, this will be the 10th <br />and final license. Which means all prospective applicants will have to either; 1), persuade the <br />Council to increase the limit,, or 2), effectively acquire a license from an existing licensee. <br />At the February 25, 2008 City Council meeting, the Council held a brief discussion on the merits of <br />increasing the number of allowable off-sale liquor licenses. A majority of the Council indicated an <br />interest in having additional dialogue regarding this matter. However, based on Council's stated <br />information needs,, existing Staff workloads, and in consideration of Council agenda items already in <br />queue, it does not appear that an informed and purposeful discussion could take place until April of <br />this year at the earliest. <br />32 Staff Recommendation <br />33 It has been the City's past practice to issue liquor licenses on a first-come, first-serve basis. <br />34 Although we have multiple suitors for the last liquor license, this applicant appears to be in the best <br />35 position to be open and operational before any others. In addition, the applicant has met all of the <br />36 licensing requirements. As such, City Staff will be recommending approval at the public hearing- <br />37 <br />38 Financial Implications <br />39 The revenue that is generated from the license fees collected is used to offset the cost of police <br />40 compliance checks, background investigations, enforcement of liquor laws, and license <br />41 administration. <br />42 <br />43 Council Action <br />44 Motion to set a public hearing for March 24, 2008 to consider the issuance of an Off-Sale <br />45 Intoxicating liquor license for Snelling Liquors. <br />46 <br />
