<br />determining the Engineer's compensation. Both parties, however, recognize that such information may change and,
<br />iii that event, the Owner and the Engineer shall negotiate appropriate adjustnicats in schedule, conipensation and
<br />Change in Services, in accordance with Section 1.3.3.
<br />ARTICLE 1.2 RESPONSIBILITIES OF THE PARTIES
<br />§ 1.2.1 The Owner and the Engineer shall cooperate with one another tic) fulfill their respective obligations, sunder- this
<br />Acreernent. Both parties shall endeavor to maintain cyood workinicy relationships arnoing all members of the Project
<br />team.
<br />1.2.2 OWNER
<br />1.2.2.1 Unless otherwise provided under this Agreement, the Owner shall provide information in a tirniely manner
<br />regarding requ 13-C file nts for and limitations on the PrQject. The Ownier shiall furnish to, the Engi
<br />C t�- 1-leer within 1 5 days
<br />after receipt of a written request, information necessary and relevant for' the Engilleel", to e'valuate, dive notice ref r•

<br />§ 1.222 The Owner shall periodically update the budget for the PF10jeCt, inCludincy that portion allocated For the Cost-
<br />of the Work. The Owner shall, not significantly increase or decrease the overall budcret, the portion of the budget

<br />allocated fOF the Cost of the Work, or contillgenvies included in the overall budget or a portion of the budget,,
<br />without the at-ireement of the Engineer to a corresponding change in the Project scope and quality.
<br />1.2.2.3 'The Owner's Designated Representative identified in Section 1.1. sly all be autfilorized to act on this
<br />Owner's behalf with respect to the Project. The Owner or the Owner's Desilowatied Representative shall render

<br />decisions in a timely manner pertaining to documents submitted by the, Engineer in lorder tio avoid unreasonable

<br />delay in the orderly and sequential progress of the Engineer's slervilicies,

<br />1.2.2.4 The Owner shall furnish the services of consultants other than those designated in Section 1.1. or authorize
<br />the Engineer to furnish then as a Cban(-.,tIn e in Services when such services are requested by the Engineer and are
<br />reasonably required by the scope of the Project.
<br />§ 1.2.2.5 Unless otherwise provided in this Agreement, the Owner shall furnish tests, inspections and rel P orts required
<br />by law or the Contract Documents, such as structural, mechanical,, and chic micla I nests, te.ist,is, for air and wilater,
<br />pollution, and tests for hazard us materials.
<br />§ 1.2.2.6 The Owner shall furnish all legal, insurance and acCOL111tilig services, including auditing services, that may
<br />be reasonably necessary at any tirne for the Project to meet the Owner's needs and interests., Nothing herein shall be
<br />construed to require the Owner to defend or indemnify the Engineer for the Engineer's own negligence, malpractice
<br />or intentional acts.
<br />1.2.2.7 The Owner shall provide prompt written notice to the Engineer if the Owliler briclornes awarle of any fault or

<br />defect in the Project, including any errors, ornissions or inconsistencies in the Engineler's Instruments of Service.
<br />§ 1.2.3 ENGINEER
<br />§ 1.2.3.1 The services performed by the Engineer, Engineer's employees and Engineer's consultants shall be as
<br />enumerated in Article L4.
<br />§ 1.2.3.2 The Engineer's services shall be performed as expeditiously as is consistent with professional Ws ill and care
<br />and the orderly progress of the Project. The Engineer shall submit for the Owner's approlval a schedule fair the
<br />performance of the Engineer's services which initially shall be consistent, with the time periods le stab] i shield in
<br />Section 1,1.2.6 and which shall be adjusted, if necessary, as the Project proceeds. 'This schedule shall include
<br />allowances for periods of time required for the Owner's review, for the performance, of the Owner's consultants, and
<br />for approval of submissions by authorities having jurisdiction over the Project. Time firnits established by this
<br />schedule approved by the Owner shall not, except for reasonable cause, be exceeded by the Engineer, or, Owner-.
<br />§ 1.2.3.3 The Engineer's Designated Representative identified in Section 1. 1.3 shall be authorized to act on the
<br />Engineer's behalf with respect to the Project.
