<br />2 Text relating to cul-de-sacs
<br />3 Councillmember Han reiterated her previous suggestion that this, and the other proposed ordinance on
<br />4 Single-Family Residential Lot Split amendments be considered at a later date to allow more substantive
<br />5 policy discussions and additional public input,
<br />6 Nan moved, lough seconded, tabling to a meeting in Ja,nulary of 2008, to a date at the City Manager's
<br />7 discretion, discussion of Agenda items Ta and b.
<br />8 Counc,ilmember Pus,t offered a friendly amendment to table discussion to the end of tonight's meeting in
<br />9 case time allowed discussion tonight.
<br />10 Councilmemb,er Nan noted that there were people in attendance at tonight's meeting wishing to speak.

<br />14 Motion failed.
<br />15 Public Works Director, Duane, Schwartz briefly reviewed the proposed City Code Text Amendment that
<br />16 would eliminate, contradictions within the Code and achieve parity between the text and the way the City
<br />17 interprets its intent; based on recent court action (October 81, 2007, Ramsey County District Court -
<br />18 Boryczka v. City of Roseville), and past interpreting by staff on City Code, Section 1103,021 D.

<br />19 C,oluncilmember Kough,, referenced substandard cul-de-sac widths and emergency vehicle access and
<br />20 turina,lround rolom�, based on Fire Code provisions.
<br />Schwartz advised, with City Attorney Squires concurring that City Code met State Fire Codes.
<br />22 Councilmember Kough opined that the City was violating State Code, but was unable to identify specific
<br />23 code violations.
<br />24 Mayor Klausing asked Councilmember Kough to review h�is notes for the references for further review by
<br />25 the City Council and City Attorney to determine compliance of City Code and State law.
<br />26 T'am McGehee
<br />27 Ms. McGehee, in the audience, interrupted Council discussion to make reference to a representative
<br />28 she 11 d spoke with in the MN State Fire marshal's office,, regarding code provisions in a "book in the library,
<br />-de-sac
<br />29 but not referenced or available on the website," related to Fire Code provisions of 96' cul
<br />30 standards without parking, and 120' with :Parking.
<br />31 Mayor Klauslng attempted to obtain further clarification, as to whether this was a recommendation or law.
<br />32 Ms. McGehee opined that the City Council was trying to satisfy one single development by enacting this
<br />33 ordlinance amendment, and further opined that this was not an of way to make policy.
<br />34 Councilmember Roe clarified that the City's standard cul-de-sac width to-date had been 100 and the

<br />35 identified existing cul-de-sacs at 80 in width had not been in compliance to-date.
<br />36 CouncIlmember Ihian opined that this was an example of the need for substantive policy discussion prior
<br />37 to making ordinance changes; and further opined that this was being brought up in response to a court
<br />38 order', based on a controversial development and addition of a cul-de-sac.
<br />39 Mayor Klausing asked Mr, Schwartz if the purpose of this amendment was to get one particular project
<br />40 approved.
<br />.�,,l Mr. Schwartz advised that the purpose of the proposed ordinance amendment was to bring all existing
<br />42 2007 into
<br />alternatively-designed cul-de-isacs, as identified in the staff report dated December 17,

<br />2, comphance with City Code. Mr. Schwartz further advised that the proposed cul-de-sac on Acorn Road
<br />44 woiu�ld also then be brought into compliance with City Code.
<br />45 Clounclimember IhIan provided several bench handouts, consisting of a web article from RealEstate
<br />46, Jolumial,com; and another, web article from The New York d'i'mes, both related to cul-de-sacs.
