k" <br />REQUEST FOR COUNCIL ACTION <br />=1L I <br />2 op <br />9 The prerty is a single family home. <br />3 9 The current owner is Mr. David Battisto who lives at the property. <br />4, The City continues to receive complaints from a neighbor about an unfinished driveway that <br />5 does not have an approved hard surface installed (currently gravel). A hard surfaced driveway <br />6 was removed in about 2008 as part of a garage addition building permit. The garage was <br />"7 finished, but not the driveway. <br />► Current violations include: <br />9 1. New driveway with a gravel surface: <br />110 a) Violation of Roseville's City Code, Section 703.04.B.7 which specifically requires residential <br />11 driveways to be hard surfaced with asphalt, concrete or pavers. <br />12 Because this is a violation of Section 703 of the City Code and not a public nuisance, the <br />13 abatement process for Public Nuisances in Section 407 is not an option. Therefore, the court <br />'14, citation process is recommended in this case. It is anticipated that the court will require the <br />15 owner to complete the driveway and this will result in compliance. <br />A status update, including pictures, will be provided at the Council hearing <br />5- <br />POLICY OBJECTIVE <br />► Property maintenance through City abatement activities is a key tool to preserving high-quality <br />residential neighborhoods. Both Imagine Roseville 2025 and the City's 2030 Comprehensive <br />Plan support property maintenance as a means by which to achieve neighborhood stability. The <br />Housing section of Imagine Roseville suggests that the City "implement programs to ensure <br />safe and well-maintained properties." In addition, the Land Use chapter (Chapter 3) and the <br />Housing and Neighborhoods chapter (Chapter 6) of the Comprehensive Plan support the City's <br />efforts to maintain livability of the City's residential neighborhoods with specific policies <br />related to property maintenance and code compliance. Policy 6.1 of Chapter 3 states that the <br />City should promote maintenance and reinvestment in housing and Policy 2.6 of Chapter 6 <br />guides the City to use code-compliance activities as one method to prevent neighborhood <br />decline. <br />Page I of 2 <br />
