Attachment H <br />1 Request by Pulte Homes of MN, ITC' for VACATION of a storm sewer easement in <br />2 support of the proposed plat of property in the NW corner of Lexington Avenue and <br />'3 County Road C-2 <br />Chair Boerigter opened the Public Hearing at .10 p.m. <br />5 Associate Planner Bryan Lloyd reviewed the request of Pulte Homes for vacation of the existing <br />6 storm sewer easement that crosses the parcel at the intersection of Lexington Avenue and County <br />7' Road C-2. Mr. Lloyd noted that a reconstructed storm sewer line will be located within a new <br />8 easement and rights-of-way as part of the current plat of the property, as detailed in Section 5.1 <br />9 of the Request for Planning Commission Action (RPCA)1 dated April 6, 2011 report. <br />10 Staff recommended approval of the proposed EASEMENT VACATION of the property in the <br />11 northwest comer of Lexington Avenue and County Road C-2; based on the comments and <br />12 findings of Sections 4-6, and the conditions of Section 7 of the RPCA dated April 6, 2011. <br />) <br />1': <br />� <br />N Discussion among Commissioners and staff included ramifications should the Pulte Homes <br />14 project not proceed; with staff advising that the vacation request would coincide with Final Plat <br />15 approval at the City Council level; and that the Public Improvement Contract would provide <br />16 further stipulations and guarantees. <br />1 7, The applicant was not present at tonight's meeting <br />18 Public Comment <br />19 Chair Boerigter closed the Public Hearing at 6.14 p.m.; no one spoke for or against. <br />20 Member Gisselquist, for the benefit of new Commissioners and/or those Commissioners not <br />21 present at previous discussions related to the Pulte Homes project and Preliminary Plat review by <br />22 the Planning Commission, opined that this request represented additional fine-tuning of the plat <br />2'3 proposal, and should cause no concern. <br />24 MOTION <br />25 Member Gisselquist moved, seconded by Member B,oerigter to recommend approval of the <br />26 proposed EASEMENT VACATION of the property in the northwest corner of Lexington <br />2 7, Avenue and County Road C-12; based on the comments and findings of Sections 4-16, and <br />28 the conditions of Section 7 of the RPCA dated April 6. 2011. <br />29 Ayes: 7 <br />'30 Nays: 0 <br />'31 Motion carried. <br />Page 1 of 1 <br />
