Special Election Timeline Examples: <br />(under proposed ordinance) <br />Example 1: Vacancy y occurs earl, y the I" year of a 4-year terry (or, alternately, ,before tl�e <br />person elected in the last regular election tales office - as happened in Little Canada in 2006), <br />January 2009 -Start of term <br />April 2009 (or January 2009) - Vacancy occurs (more than 10 weeks before start of filing for the <br />2010 regular city election, and more than 2 years remaining in term) <br />• State statute requires a special election at the next regular city election - approx. 20 <br />months out - unless city ordinance provides for one sooner <br />• Proposed city ordinance requires a special election ASAP <br />May 2009 (or January 2009) - Appointment made <br />(Appointee serves until special election result is certified - approx. 2 -3 months) <br />July 2009 (or April 2009) - Special election, per ordinance, within approx. 3 months of vacancy <br />(Winner serves remainder of term - approx 3 years & 5 -6 months (or 3 years & 8 -9 months)) <br />Example 2 : Vacancy y occurs earl, y in the Zd year of a 4-year tern. <br />January 2009 -Start of term <br />March 2010 - Vacancy occurs (more than 10 weeks before start of filing for the 2010 regular city <br />election, and more than 2 years remaining in term) <br />• State statute requires a special election at the next regular city election - approx. 8 <br />months out - unless city ordinance provides for one sooner <br />• Proposed city ordinance requires a special election ASAP <br />April 2010 - Appointment made <br />(Appointee serves until special election result is certified - approx. 2 -3 months) <br />June 2010 - Special election, per ordinance, within approx. 3 months of vacancy <br />(Winner serves remainder of term - approx. 2 years & 6 -7 months) <br />Example 3 : Vacancy y occurs in middle of the 2d year of a 4-year tern. <br />January 2009 -Start of term <br />May 2010 - Vacancy occurs (less than 10 weeks before start of filing for the 2010 regular city <br />election, and more than 2 years remaining in term) <br />• State statute requires a special election at the next regular city election - approx. 7 <br />months out - unless city ordinance provides for one sooner <br />• Proposed city ordinance defers to state statute requirement due to timing <br />May /June 2010 - Appointment made <br />Page 4 of 6 <br />
