5.5 There is an existing utility and drainage easement that must be provided on the Final Plat. This <br />easement is 15 feet wide and lies adjacent to Cleveland Avenue. <br />5.0 No other easement or right -of -way dedications will be required at this time. The City will defer <br />such dedications of additional right -of -way needs until the outlot is re- platted. <br />5.7 The re- platting of Lots 1, 2, 3, 15, 19, and 20, Block B, Twin View into an outlot and lot of 1.2 <br />acres, may require park dedication consistent with Minnesota State Statutes 402.355 and <br />§ 1103.07 of the Roseville City Code. The applicant shall work with the Park and Recreation <br />Department on determining whether such a dedication or payment in lieu of land dedication is <br />required. <br />6.0 STAFF COMMENTS AND RECOMMENDATION <br />0.1 The Community Development and Public works /Engineering Departments recommend <br />approval to enter into the Vacation and Re- Granting Agreement, which establishes the process <br />by which the Final Plat shall be recorded, subject to the following condition: <br />a. Approval of the Final Plat of Twin Lakes Addition. <br />0.2 The Planning Division and Public works Department further approval the FINAL PLAT of T`TIN <br />LAKES ADDITION, subject to the following conditions: <br />a. Approval Of the VACATION and RE- GRANTING AGREEMENT. <br />b. The property owner maybe responsible for park dedication consistent with Minnesota <br />State Statutes 462.358 and X1103.07 of the Roseville City Code, as recommended by the <br />Park and Recreation Commission and as approved by the Roseville City Council. <br />7.0 SUGGESTED CITY COUNCIL ACTION <br />7.1 BY MOTION, APPROVE the VACATION and RE- GRANTING AGREEMENT between the property <br />owner (Old Dominion) and the City of Roseville, subject to the condition in Section 0 of the <br />project report dated December 15, 2005. <br />7.2 BY MOTION, APPROVE the FINAL PLAT for the Cent Ventures II and the property at 2750 <br />Cleveland Avenue, based on the comments and conditions of Section 0 of the project report <br />dated December 15, 2005. <br />Prepared by: City Planner Thomas Paschke <br />Attachments: A: Area map <br />B: Aerial photo <br />C: Final Plat <br />D: Vacation and Re- Granting Agreement <br />Page 3 of 3 <br />
