Attachment A SETTLEMENT AGREEMENT AND RELEASE of ALL CLAIMS Real Life Church ("Church") and the City of Roseville ("City") hereby agree as follows: WHEREAS. Church brought a claim against City in Ramsey County District Court File 61 -CV -07 -4620, challenging assessments for Street Project No. 05 -02, alleging the assessments were contrary to law; WHEREAS, the City denied the assessments were contrary to law; WHEREAS, the specific assessments levied against Church's property under Project 05 -02 are as follows: Chatsworth assessment $10,277 Lovell assessment $2,005 Residential assessment $8,110 WHEREAS, the parties wish to resolve all claims against each other. NOW, THEREFORE, the parties agree as follows: 1. The residential assessment in the amount of $8,110 described above shall be reduced to $5,080. All other aspects of the assessment(s) for Project 05-02 shall remain as assessed. 2. Church, for the sole consideration described herein, does hereby and for its heirs, executors, administrators, successors, and assigns release, acquit and forever discharge City, and its agents, council members, employees, servants, successors, heirs, executors, administrators, insurers, assigns, and any other person or entity associated in interest therewith from any and all claims, actions, causes of action, demands, rights, damages, costs, loss of service, expenses and compensation whatsoever, which Church now has or which may hereafter accrue on account of or in any way growing out of those claims in the litigation described above. 3. It is expressly understood and agreed that Church hereby releases and dismisses, with prejudice and on the merits, all claims and causes of action which are or could have been made in the lawsuit entitled Real Life Church v. City of Roseville, Ramsey County Court File No. 62 -CV -07 -4620. 4. It is understood and agreed that this settlement is the compromise of disputed claims, that the payment made is not to be construed as an admission of liability on the part of the either Church or City, and that the parties deny liability therefore and intend merely to avoid litigation.
