Attachment D <br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br />1 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City <br />2 of Roseville, County of Ramsey, Minnesota, was held on the 18th day of April 2011 at 6:00 p.m. <br />3 <br />4 and <br />5 <br />The following Members were present: <br />were absent. <br />Council Member introduced the following resolution and moved its adoption: <br />s RESOLUTION NO. <br />7 A RESOLUTION APPROVING AN ACCESSORY DWELLING UNIT AS A <br />s CONDITIONAL USE AT 3091 FAIRVIEW AVENUE (PF11 -007) <br />9 WHEREAS, Derek Thorson, applicant for approval of the proposed conditional use, <br />10 owns the property at 3091 Fairview Avenue, which is legally described as: <br />11 PIN:04- 29 -23 -21 -0073 <br />12 Hedlund's Addition, the S 60 feet of Lot 3 and the N 36 feet of Lot 4 and the N 36 feet of the <br />13 E 40 feet of Lot 9 and the S 60 feet of the E 40 feet of Lot 10, all in Block 1 <br />14 WHEREAS, the Roseville Planning Commission held the public hearing regarding the <br />15 proposed CONDITIONAL USE on April 6, 2011, voting 7 -0 to recommend approval of the use based <br />16 on the comments and findings of the staff report prepared for said public hearing; and <br />17 WHEREAS, the Roseville City Council has determined that approval of the proposed <br />18 CONDITIONAL USE will not result in adverse impacts to the surrounding properties based on the <br />19 following findings: <br />20 a. The proposed accessory dwelling unit is not in conflict with the Comprehensive <br />21 Plan because it advances land use Policy 7.4 by promoting increased housing <br />22 options in the community; <br />23 b. The proposed use is not in conflict with a Regulating Map or other adopted plan <br />24 because no such plans apply to the area surrounding the property; <br />25 C. The proposed use is not in conflict with City Code requirements, and the <br />26 conditional use approval can be rescinded if the use of the accessory dwelling unit <br />27 fails at any time to comply with all applicable Code requirements or conditions of <br />28 the approval; <br />29 d. The proposed accessory dwelling unit, which is suitable for up to two occupants, <br />30 will not create an excessive burden on parks, streets, and other public facilities; <br />31 and <br />32 e. The proposed accessory dwelling unit is a small residential use that will not be <br />33 injurious to the surrounding residential neighborhood, will not negatively impact <br />Pagel of 3 <br />
