Department Approval <br />i�- <br />R,Sy68FaC+E <br />REQUEST FOR COUNCIL ACTION <br />Date: 05/18/09 <br />Item No.: 7.e <br />City Manager Approval <br />Item Description: Approve Capitol Region Watershed District Memorandum of Agreement for <br />Maintenance of Stormwater Management Facilities <br />1 BACKGROUND <br />2 This year we are reconstructing Roselawn Avenue between Hamline Ave and Victoria Street. Storm <br />3 water management facilities including rain gardens and biofiltration basins within the Roselawn Avenue <br />4 right- of- way are being constructed as part of this project. These facilities are necessary to meet City <br />5 and Watershed District storm water treatment requirements. <br />6 <br />7 This project is within the Capitol Region Watershed District. The District requires the installation and <br />8 maintenance of new storm water management facilities according to the district rules for city public <br />9 works' projects, including street reconstruction projects. One of the permit requirements is to enter into <br />lo a Memorandum of Agreement covering the maintenance of the new storm water management facilities. <br />11 POLICY OBJECTIVE <br />12 This agreement will cover all new storm water management facilities constructed in association with <br />13 road reconstruction projects within Capitol Region Watershed District. Maintenance of Storm Water <br />14 Facilities is required by our Minnesota Pollution Control Agency Storm Water Pollution Prevention <br />15 Permit (SWPPP). It is also consistent with our Public Works Policies to adequately maintain <br />16 infrastructure. Attached is the draft agreement. We are working with the CRWD attorney on finalizing <br />17 the language in the agreement. <br />18 FINANCIAL IMPACTS <br />19 The Public Works Department is committed to maintaining new facilities when they are installed. This <br />20 agreement does not increase our level of maintenance over what we would have done without the <br />21 agreement. <br />22 STAFF RECOMMENDATION <br />23 Staff recommends that the City Council approve the Capitol Region Watershed District Memorandum of <br />24 Agreement for Maintenance of Stormwater Management Facilities. <br />25 REQUESTED COUNCIL ACTION <br />26 Motion to approve Capitol Region Watershed District Memorandum of Agreement for Maintenance of <br />27 Stormwater Management Facilities. <br />Page 1 of 2 <br />
