MEETING 4-13-81 <br />REQUEST FOR COUNCIL ACTION DATE: <br />!,ittached is a letter from Mr, Phil Pommier of 582 West Shryer Avenue reuestin, <br />a S. <br />permission t o a erect four foot (4') high fence a q <br />long his south property line, <br />As the Council will recall, Resolution No. 6821 adopted May 21, 1979, states that <br />the City may require reasonable dedication of rights-of-way as a condition for <br />approval of building permits where no right-of-way has been previously provided, <br />or the construction falls within the potential right-of-way setback area. No <br />method of obtaining a variance to this requirement was specified in the resolution. <br />I <br />Mr. Pommier is, however, requestinq that "' he be permitted to construct the fence <br />without the dedication of right-of-way for the reasons cited in his letter. <br />A four foot high fence would normally, barring dedication requirements, be permittet <br />at the proposed location. Additionally, the City has no current plans to widen <br />Moundsview Avenue. <br />If approved, with the condition that the fence be removed <br />by the owner within 30 days" notice at no cost to the City and at such time as <br />.the City determines to be in the pUblic. interest. <br />Council Action Requestede.
