2 December 1981 <br />PLANNING REPORT <br />CASE NUMBER: 1351-81 <br />APPLICANT: Carl Eng and Tommie Braddock <br />LOCATION: Laurie Road, west of Midlothian Road and <br />East of Haddington Road (see sketch) <br />ACTION REQUESTED: vacation of Right -of --way <br />PLANNING cOHSIDERATIOHS <br />1. The Engs live at the southwest corner Of Laurie and Midlothian Road and <br />the Braddocks live at the southeast corner of Haddington and Laurie Road& <br />North of these single family lots there is an existing 30 foot of right - <br />of -way originally dedicated for the extension of Laurie Road westerly and <br />easterly of the Westmoor Addition, Attached is a copy of this portion of <br />the section map showing the westmoor Addition and the rights -of -way <br />proposed to be vacated. <br />2. The staff-has reviewed the right --of -way vacation proposal with the <br />applicants and find there is no apparant reason for maintaining the <br />right --of -way for street purposes, <br />3. There are, however, existing water mains in each of the 30 foot sections <br />of right-of-way proposed to be vacated. The Engineering Staff therefore <br />suggests that any vacation of the right-of-way be accompanied by an <br />easement for utility purposes for the full 30 feet. <br />As you know, inasmuch as these portions of Lurie road were originally <br />dedicated as part of the westmoor Addition Plat, when the right-of-way <br />is vacated it becomes the property of the continguous lot ownersr in this <br />case, the Engs and the Braddocks+ However, assessments are charged for <br />this portion of the lot ]used on a percentage of previous assessments <br />applied to the contiguous properties, In this case an assessment of <br />$324,00 for water and sewer would be applied to the new 30 foot strip <br />added to the let, and an assessment of $205.25 would be added ,to the <br />Era.ddocks' lot. These assessments are for a water main constructed in <br />1963 and the sanitary sewer constructed in 1957-b <br />
