(MnDOT Agreement <br />No. 99918) <br />1 BACKGROUND <br />2 The Northeast Suburban Campus Connector Proj ect (Fairview Pathway Project), is funded by a <br />3 Federal transportation grant. In an effort to streamline this process, Mn /DOT uses the Delegated <br />4 Contract Process (DCP), that allows local agencies to let and administer construction contracts for <br />5 Federal Aid projects. Through the Delegated Contract Process, MnDOT acts as the City's agent to <br />6 accept federal funds from FHWA. The City advertises for bids, administers the contract, oversees <br />7 construction, and processes payments. The attached Agency Agreement outlines the responsibilities <br />s of the City and State for the Delegated Contract Process. <br />9 POLICY OBJECTIVE <br />lo In 2008, the City was awarded Transit for Livable Communities, Non - Motorized Transportation <br />11 Pilot Program Grant Funds Federal Surface Transportation Program (STP) funding to construct <br />12 this project. Phase 1 construction started last fall and will be completed in Spring 2012. Phase 2 <br />13 is scheduled for construction Summer 2012. <br />14 The City cannot go out to bid for Phase 2 of this project without an updated Agency Agreement. <br />15 FINANCIAL IMPACTS <br />16 Federal aid is a reimbursement program. Federal funds cannot be released until after an expense <br />17 has been incurred. Under the DCP, local agencies need to make partial payments to the <br />18 contractor. MnDOT then reimburses these expenditures with federal funds.
