EXTRACT OF MINUTES OF MEETING OF THE <br /> CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br /> Roseville, County of Ramsey, Minnesota, was held on the 23rd day of July, 2007, at 6:00 p.m. <br /> The following members were present: Pust, Roe, Ihlan, Kough, and Mayor Klausing <br /> and none were absent. <br /> Council Member Kough introduced the following resolution and moved its adoption: <br /> RESOLUTION NO. 10526 <br /> A RESOLUTION APPROVING A VARIANCE TO §1004 OF THE ROSEVILLE CITY <br /> CODE FOR JOANN KURTZ AT 3015 SOUTH OWASSO BOULEVARD (PF07-036) <br /> WHEREAS, Joann Kurtz is the owner of property at 3015 South Owasso Boulevard; and <br /> WHEREAS, the subject property is legally described as: <br /> Part of Lot 30, Block 2, The Townhomes of Lake Owasso, lying northerly of the line beginning <br /> at a point on westerly line of said lot 30 a distance 137.85 feet north of the corner of said lot 30, <br /> thence north 88 degrees 53 minutes 30 seconds east to easterly line of said Lot 30 and there <br /> terminating. <br /> PIN: 01-29-23-12-0068 <br /> WHEREAS, Section 1004.016 (Driveway Setbacks) of the Roseville City Code requires a <br /> 5-foot setback from side property lines for driveways in the Single-Family Residence Zoning <br /> District; and <br /> WHEREAS, Joann Kurtz seeks to allow pavement to encroach up to 4 feet into the <br /> required setback; and <br /> WHEREAS, The Roseville Planning Commission held a public hearing regarding the <br /> requested VARIANCE, voting 6-0 to recommend approval of the request based on the comments <br /> and findings of the staff report dated July 11, 2007; and <br /> WHEREAS, the Roseville City Council has determined that hardships exist and that <br /> approval of the requested VARIANCE will not compromise the health, safety, and general <br /> welfare of the citizens of Roseville; <br /> NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to APPROVE <br /> the request by Joann Kurtz for a VARIANCE to Section 1004.016 (Driveway Setbacks) of the <br /> Roseville City Code subject to the following condition; <br /> Page 1 of 3 <br />
