EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF ROSEVILLE Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, County of Ramsey, Minnesota, was held on the 23rd day of July, 2007, at 6:00 p.m. The following members were present: Pust, Roe, Ihlan, Kough, and Mayor Klausing and none were absent. Council Member Kough introduced the following resolution and moved its adoption: RESOLUTION NO. 10526 A RESOLUTION APPROVING A VARIANCE TO §1004 OF THE ROSEVILLE CITY CODE FOR JOANN KURTZ AT 3015 SOUTH OWASSO BOULEVARD (PF07-036) WHEREAS, Joann Kurtz is the owner of property at 3015 South Owasso Boulevard; and WHEREAS, the subject property is legally described as: Part of Lot 30, Block 2, The Townhomes of Lake Owasso, lying northerly of the line beginning at a point on westerly line of said lot 30 a distance 137.85 feet north of the corner of said lot 30, thence north 88 degrees 53 minutes 30 seconds east to easterly line of said Lot 30 and there terminating. PIN: 01-29-23-12-0068 WHEREAS, Section 1004.016 (Driveway Setbacks) of the Roseville City Code requires a 5-foot setback from side property lines for driveways in the Single-Family Residence Zoning District; and WHEREAS, Joann Kurtz seeks to allow pavement to encroach up to 4 feet into the required setback; and WHEREAS, The Roseville Planning Commission held a public hearing regarding the requested VARIANCE, voting 6-0 to recommend approval of the request based on the comments and findings of the staff report dated July 11, 2007; and WHEREAS, the Roseville City Council has determined that hardships exist and that approval of the requested VARIANCE will not compromise the health, safety, and general welfare of the citizens of Roseville; NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to APPROVE the request by Joann Kurtz for a VARIANCE to Section 1004.016 (Driveway Setbacks) of the Roseville City Code subject to the following condition; Page 1 of 3
