Regular City Council Meeting <br /> Monday, December 12, 2011 <br /> Page 26 <br /> Recognizing that Councilmember Pust was an attorney and would prefer review- <br /> ing the contract, Councilmember Johnson expressed his confidence in the exper- <br /> tise of the City's legal counsel in negotiating the contract language in the best in- <br /> terest of the City. <br /> Mayor Roe noted that most action of this nature included authorizing staff to ne- <br /> gotiate the contract, and authorize the Mayor and City Manager to execute the <br /> document upon recommendation of the City Council; and questioned if that was <br /> not indicated in this case as well. <br /> The makers of the motion amended their original motion accordingly and as fol- <br /> lows: <br /> Johnson moved, Willmus seconded, authorizing the Fire Department to <br /> award the contract for Construction Management Services for Phase II of <br /> the new Fire Station Project to Bossardt Corporation in an amount not to <br /> exceed $435,300; amended to authorize the Mayor and City Manager to <br /> execute the documents,pending approval of the City Attorney. <br /> Councilmember Pust clarified that her concerns were based on policy reasons un- <br /> der her purview as a Councilmember, not as an attorney. <br /> Roll Call <br /> Ayes: Johnson; Willmus; and Roe. <br /> Nays: McGehee and Pust. <br /> Motion carried. <br /> g. Consider Awarding the Contract for Architectural Services for Phase II of <br /> the New Fire Station Project to CNH Architects <br /> Johnson moved, Willmus seconded, authorizing the Fire Department to award the <br /> contract for Architectural Services for Phase II of the new Fire Station Project to <br /> CNH Architects in an amount not to exceed $506,250; and authorizing the <br /> Mayor and City Manager to execute the documents, pending approval of the <br /> City Attorney. <br /> In noting the disparity between this firm and other original bidders; Councilmem- <br /> ber McGehee suggested that CNH reconsider their original bid and seek to bring <br /> it into line with those other bidders. <br /> Roll Call <br /> Ayes: Johnson; Willmus; Pust; and Roe. <br /> Nays: McGehee. <br /> Motion carried. <br /> h. Consider City Abatement for Unresolved Violations of City Code at 1065 <br /> Ryan Avenue <br /> Permit Coordinator Don Munson reviewed violations at this vacant and in fore- <br /> closure single-family detached home, located at 1065 Ryan Avenue, and currently <br /> owned by JP Morgan Chase Bank.
