<br />( <br /> <br />) <br /> <br />WHEREAS, there exists in full force and effect Traffic <br /> <br />Control Signal Agreement No. 64296 dated November 10, 1987, <br /> <br />entered int9.by and between the State of Minnesota, Department of <br /> <br />Transportation, hereinafter referred to as the "State", and the <br /> <br />City of Roseville, hereinafter referred to as the "City", <br /> <br />WITNESSETH: <br /> <br />WHEREAS, the State has determined that there is <br /> <br />justification and it is in the public's best interest to install <br /> <br />emergency vehicle pre-emption at the existing traffic control <br /> <br />signal on Trunk Highway No. 51 (Snelling Avenue) at Lydia Avenue: <br /> <br />and <br /> <br />WHEREAS, pursuant to Minnesota Statutues, <br />( Section 161.39, the Commissioner of Transportation may upon <br /> <br />( <br />\ <br />'--- <br /> <br />request provide technical and engineering advice, assistance and <br /> <br />supervision to any county or municipality: and <br /> <br />WHEREAS, the City requests and the State agrees to <br /> <br />provide an Emergency Vehicle Pre-emption System, hereinafter <br /> <br />referred to as the "EVP System," as a part of the existing <br /> <br />traffic control signal installation in accordance with the terms <br /> <br />and conditions hereinafter set forth: and <br /> <br />WHEREAS, the materials, equipment, labor and <br /> <br />miscellaneous items necessary to construct, operate, maintain, <br /> <br />revise and remove said EVP System shall be at the- sole cost and <br /> <br />expense of the City: and <br /> <br />S.A. 4t1 to <br />64296 <br />-1- <br /> <br />~\ <br /> <br />/ <br />
