EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF ROSEVILLE * * * * * * * * * * * Pursuant to due call and notice thereof, a special meeting of the City Council of the city of Roseville, County of Ramsey, Minnesota was duly held on the 7th day of November, 1988, at 7:30 p.m. The following members were present: Johnson, Cushman, Matson, Kehr, and Rog, and the following were absent: None. Member Kehr introduced the following resolution and moved its adoption: RESOLUTION NO. 8377 TERMINATION OF CITY MANAGER WHEREAS, on September 26, 1988, the City Council of the City of Roseville relieved James Andre of his duties as City Manager and appointed steve North as Acting city Manager; and WHEREAS, on September 27, 1988, James Andre requested a public hearing pursuant to Minnesota Statute 412.641; and WHEREAS, a public hearing was held pursuant to certain charges on November 7, 1988, all in accordance with Minnesota Statute 412.641; and WHEREAS, the City of Roseville and James Andre had entered into a contract wherein James Andre was to commence assuming the duties of Manager on May 1, 1974, and said contract provided James Andre with certain termination pay; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Roseville, as follows: 1. James Andre is relieved of any further responsibilities as City Manager and further that all compensation, except as hereinafter provided, be terminated effective at the end of the business day of November 7, 1988. 2. The Acting city Manager is hereby directed to promptly issue a city draft to James Andre for an amount equal to his last three months salary, subject to the same deductions that were applicable to his previous compensation, all as required by his employment contract. 3. The Acting City Manager is further directed to promptly issue a city draft to James Andre for any amount due for unused vacation pay for Calendar Year 1988. This amount shall be determined by subtracting the number of days of vacation previously taken by James Andre in 1988 from fifteen (15). He shall be paid for such unused vacation, and this amount shall be subject to the same deductions as specified in Paragraph 2 above.
