"I VU\J. <br /> <br />Councilmember Wiski introduced the following resolutions and moved its adoption: <br /> <br />RESOLUTION 9397 <br /> <br />NORTH McCARRONS BOULEVARD, SOUTH McCARRONS <br />BOULEVARD, AND ROSELÅ WN Â V ENùE <br />CITY PROJECT P-97-03, S.A.P. 160-249-01 and 160-250-01 <br /> <br />WHEREAS, North McCarrons Boulevard and Roselawn Avenue between Rice Street (T.H. 49) <br />and Dale Street is designated Municipal State Aid roadway No. 249; and <br /> <br />WHEREAS, South McCarrons Boulevard between Roselawn Avenue and Rice Street (T. H. 49) <br />is designated as Municipal State Aid roadway No. 250; and <br /> <br />WHEREAS, the City ofRoseville wishes to use Municipal State Aid dollars for constructing a <br />nathwav a!\ nart of the nroiect: and <br />r-~--··-.I -~ r--- -- ---- r--J---' ----~ <br /> <br />WHEREAS, in order to use Municipal State Aid dollars, the pathway must meet Municipal State <br />Aid standards which includes Minnesota Rule 8820.9995 which requires a 10-foot width for <br />('nm"';nprl n..thuT"'''· ..nrl <br />__.........v.&......__ t'-.........,.'" - J, -......- <br /> <br />WHEREAS, the current design for the pathway along North McCarrons Boulevard and South <br />McCarrons Boulevard is 8 feet wide; and <br /> <br />WHEREAS, if the State Aid design standards cannot be met, a variance must be granted to allow <br />the use of Municipal State Aid dollars to be spent on the pathway; and <br /> <br />WHEREAS, the City ofRoseville has applied for a variance and received conditional approval for <br />the variance to the pathway standard; and <br /> <br />WHEREAS, the condition of this approval is the receipt of a resolution by the Roseville City <br />Council that holds harmless the State of Minnesota for granting a variance to Minnesota State Aid <br />streets No. 249 and No. 250 between Rice Street (T. H. 49) and Dale Street; <br /> <br />NOW THEREFORE BE IT RESOLVED by the Council of the City ofRoseville, Minnesota, that <br />the City ofRoseville indemnifies, saves, and holds harmless the State of Minnesota and its agents <br />and employees of and from any and all claims, demands, actions, or cause of action arising out of <br />
