Councilmember Wiski introduced the following resolutions and moved its adoption: RESOLUTION 9397 NORTH McCARRONS BOULEVARD, SOUTH McCARRONS BOULEVARD, AND ROSELÅ WN Â V ENùE CITY PROJECT P-97-03, S.A.P. 160-249-01 and 160-250-01 WHEREAS, North McCarrons Boulevard and Roselawn Avenue between Rice Street (T.H. 49) and Dale Street is designated Municipal State Aid roadway No. 249; and WHEREAS, South McCarrons Boulevard between Roselawn Avenue and Rice Street (T. H. 49) is designated as Municipal State Aid roadway No. 250; and WHEREAS, the City ofRoseville wishes to use Municipal State Aid dollars for constructing a nathwav a!\ nart of the nroiect: and r-~--··-.I -~ r--- -- ---- r--J---' ----~ WHEREAS, in order to use Municipal State Aid dollars, the pathway must meet Municipal State Aid standards which includes Minnesota Rule 8820.9995 which requires a 10-foot width for ('nm"';nprl n..thuT"'''· ..nrl __.........v.&......__ t'-.........,.'" - J, -......- WHEREAS, the current design for the pathway along North McCarrons Boulevard and South McCarrons Boulevard is 8 feet wide; and WHEREAS, if the State Aid design standards cannot be met, a variance must be granted to allow the use of Municipal State Aid dollars to be spent on the pathway; and WHEREAS, the City ofRoseville has applied for a variance and received conditional approval for the variance to the pathway standard; and WHEREAS, the condition of this approval is the receipt of a resolution by the Roseville City Council that holds harmless the State of Minnesota for granting a variance to Minnesota State Aid streets No. 249 and No. 250 between Rice Street (T. H. 49) and Dale Street; NOW THEREFORE BE IT RESOLVED by the Council of the City ofRoseville, Minnesota, that the City ofRoseville indemnifies, saves, and holds harmless the State of Minnesota and its agents and employees of and from any and all claims, demands, actions, or cause of action arising out of
