EXTRACT OF MINUTES OF MEETING OF CITY COUNCIL CITY OF ROSEVILLE RAMSEY COUNTY, MINNESOTA Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, County of Ramsey, Minnesota, was duly held in the City Hall at 2660 Civic Center Drive, Roseville, Minnesota, on Monday, the 14th day of April, 1997, at 6:30 p.m. The following members were present: Wiski, Goedeke, Mastel, Maschka, Wall and the following were absent: None. Member Mastel introduced the following resolution and moved its adoption: RESOLUTION NO. 9402 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT TO ALLOW CONSTRUCTION OF ONE CELLULAR TELEPHONE TOWER BY APT WHEREAS, pursuant to Minnesota Statutes 462.357, the City of Roseville has adopted zoning regulations to control land uses throughout the City; and WHEREAS, said regulations provided that a cellular tower be allowed within the confines of a City owned or controlled parcel as a condition use; and WHEREAS, approval of a conditional use permit for construction of one cellular telephone tower has been requested by APT Communications for a site located in the property commonly known as the St. Paul Water Authority property; and WHEREAS, the Roseville Planning Commission recommended approval of such conditional use permit subject to certain conditions on March 12, 1997; and WHEREAS, the Roseville City Council considered such conditional use permit at a meeting held on April 14, 1997. WHEREAS, State law requires this permit be issued by virtue of the 60 day rule contained in State Statute Section 1519 adopted by the State Legislature. NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Roseville, Minnesota, Ramsey County, Minnesota, that a conditional use permit for an R-1 zoning district on property owned or controlled be approved subject to the conditions within Exhibit "A", and subject to City ownership of the St. Paul Water Authority property.
