Gerald Jubert, owner of 403 County Road B. has requested approval to put a fence along the west lot line of this property and extend it east to the edge of his home, A large gate will be installed to provide ingress and egress, if needed. The staff has reviewed this request and would be agreeable to the construction of the fence, as long as it was clearly understood that should the city need to make use of the easement, removal of the fence and relocation would be the responsibility of the property owner, The Juberts acknowledge this responsibility and are agree- able to it. In the past, a simple agreement between the city and the property owner setting forth these conditions have been signed by both parties and has served to accomplish this purpose. RECOMMENDED ACTION: Motion authorizing the mayor and manager to sign an agreement with Gerald and Beth Jubert of 403 County Road B, authorizing them to construct a fence on the city's utility easement, contingent upon their ac- ceptance of all responsibility for said fence.
