Gerald Jubert, owner of 403 County Road B. has requested approval <br />to put a fence along the west lot line of this property and extend it <br />east to the edge of his home, A large gate will be installed <br />to provide ingress and egress, if needed. <br />The staff has reviewed this request and would be agreeable to the <br />construction of the fence, as long as it was clearly understood <br />that should the city need to make use of the easement, removal of <br />the fence and relocation would be the responsibility of the property <br />owner, The Juberts acknowledge this responsibility and are agree- <br />able to it. In the past, a simple agreement between the city and <br />the property owner setting forth these conditions have been signed <br />by both parties and has served to accomplish this purpose. <br />RECOMMENDED ACTION: <br />Motion authorizing the mayor and manager to sign an <br />agreement with Gerald and Beth Jubert of 403 County <br />Road B, authorizing them to construct a fence on the <br />city's utility easement, contingent upon their ac- <br />ceptance of all responsibility for said fence. <br />MEETING <br />REQUEST FOR COUNCIL <br />ACTION <br />DATE' <br />6/14/82 <br />AGENDA SECTION: <br />ORIGINATING DEPT. /DIV.: <br />DEPT.
