3
3 December 1980
PLANNING REPORT
CASE NUMBER. 1285 -8Q
PLANNIN coNS2 DERATIoNS
1 several years ago, Sam cave platted the North Boundary Subdivision (of
which the subject property is a part) -and the subdivision to the west
(North Boundary Second Addition) . The property in question and a similar
amount of land to the west was reserved for a. ponding area which was
constructed by the c1ty. The city purchased a drainage easement from
Mr. cave so as to retain the rights to pond water on the property in
question and the property immediately to the west,
This past year, Mr. cave had a consulting engineer prepare drainage
calculations which indicated that not all of the ponding area was
necessary. These calculations have been reviewed and approved by the
Public Works Department. The analysis indicated that the eastern 70 feet
of the property could in fact he developed. Mr. Cave* therefore , proposes
to purchase. from the city the easement rights for the easterly 70 feet
of the three lets proposed for the property. A copy of the proposed plat
is attached.
3J Also attached is a statement from Mr. Cave indicating the conditions
under which he proposes to develop the land. Also attached is a profile
drawing indicating the relationship between the land proposed to be
developed as it relates to the ponding area to the west. When examining
this profile drawing, be aware that the vertical scale is different from
the horizontal. This accounts for the odd - looking structure indicated
on the ?o foot portion on which homes are proposed to be built.
4 You may recall that the rest of the subdivision along Evelyn Street platted
by Mr. cave was constructed with the 25 foot front yard rather than the
normal 30 foot required. This was dome as an experiment and as a
recognition of the fact that the lots are relatively shallow, and there-
fore, resulted in a five foot deeper rear yard. Mr. Cave is asking, then,
for approval of the preliminary plat and the continuance of the 25 foot
front yard policy as previously established on this street.
5 We suggest that any approvals graanted tae conditioned as stipulated in
Mr. cave's letter or as may be amended by the Planning Commission and
Council,
