Hearings I Adm MEETING 1-12-81 DATE: "May a statutory city, through its zoning code, regulate land use of a property owned by the School District which is no longer used as a public school, and is leased to public agencies or quasi-public organizations by making such uses permitted only after application for an issuance of a special use pe-rmit by the City?" 1 0 The Attorney General's opinion concluded: "We believe that School Districts are subject to reasonable ordinances effecting the leasing of school property to other public and not for profit organizations." The Planning Commission at its December meeting recommended approval of the propose. ordinance. Subsequent to the Planning Commission action, Lloyd Nielson, Superinten dent of School District 623, submitted suggestions regarding the ordinance. The suggestions related to clarification of permitted uses when operated by a public school district (Section 7.260(5)) and additional information regarding the number of employees permitted on the site (Sections 5.495 and 5,505), 1 The City Attorney, City Planner, and staff have incorporated these suggestions into the attached ordinance, The additional language is underlined, Section 7,260, Sub. 6, also contains a change (underlined). This additional language would mean that low impact public or quasi-public uses in a building formerly publicly owned and now owned by a church would be a permitted use. This change is put forth for Council consideration because of the possible purchase of North Heights School by the North Heights Lutheran Church, oT other similar purchases.
