TOO City Council <br />FROM* Steve North< <br />4>� <br />SUBJECT: On-Sale Liquor License Moratorium <br />Last September the Council discussed the fact that Roseville Is authorize4 <br />by state law to issue up to 18 on-sale liquor licenses, ■ <br />that time 15 <br />licenses had been approved (14 licenses in 1981), Inquiries had also been <br />received from 3 or 4 other parties interested in on-sale licenses, <br />Because of the concern over the small number of licenses remaining, the Council <br />decided to place a question on the November election ballot asking whether the <br />City should be allowed to exceed the number-_-�of liquor licenses now authorized <br />by law. The Council at the same time also placed a moratorium on the accept- <br />znce of applications for on-sale liquor licenses until January 12,, 1981a The <br />referendum was defeated on a vote of 8,641 yes and 9,008 no. <br />During the discussions the Council considered the possibility that 14 f the <br />referendum failed, the liquor licensing ordinance could be reviewed and <br />increased standards adopted, <br />In preliminary discussions, the City Attorney has indicbted that it is his <br />opinion the Council could establish different standards for the issuance of <br />new licenses and retain the existing standards for' the present license holders. <br />He indicated that any proposed amendments would need to be carefully reviewed <br />for the-ir legality. <br />Ine area the Council may wish to explore is the possible repeal of changes in <br />the licensing ordinance since its original adoptian in 1969: <br />The original ordinance required restaurant seating of not less than <br />175 guests and the principal part of the business (over 50%) should <br />be from the serving of foods, That has been amended to permit a <br />seating caDacity of 100 - 174 with at least 50% of the sales from the <br />service of meals and when the seating capacity is 175 or more, at <br />least 25% of the sales must be from the service of meals. <br />t. The annual license fee has been reduced from $10,000 to $7,000., <br />t. The original ordinance required $5,000 of the $10,000 fee to be paid- <br />before the application is accepted and the balance before the licenst <br />is issued, The ordinance was amended to provide that $500 of the <br />$7,000 fee be paid before the application is accepted and the balance <br />a 4 <br />before the license issued. <br />
