3 September 198j <br />WAWRH&jffti Gvw � <br />UASE NUMBER: 1268-80 <br />APPLICANT: Mark Johnson <br />LOCATION: Southeast Corner of County Road D and <br />Mildred Drive <br />ACTION REQUESTED: Variance to Fence Setback Requirement <br />1, Mr. and Mrs. Johnson recantly constructed a six foot high stockade fence <br />along their side property line abutting County Road D without obtaining a <br />permit. The Zoning Ordinance permits only fences which do not exceed <br />3� feet in height 'in required setbacks for front yards and for. side yards <br />abutting streets. <br />2. The Johnson's brought the case before the MI-nor Variance Board on <br />14 July 1980 to request a variance to retain the six foot bigh fence on <br />the property line. The Minor Variance 'Board recommended denial of the <br />request. The Minor Variance Board noted that the fence could be moved <br />back to the required 30 foot setback line or left in 'Its present positiorX <br />and cut down to the 311 foot he-ight maximum. <br />3. The Johnson's are now bringing the request before the Planning Commiss, <br />I ion <br />based on the hardship that the fence is already in place.. The fence was <br />installed in order to contain the applicant's two dogs and to provide <br />screening from traffic along County Road D. Relocating the fence would <br />involve considerable time, effort, and expense. <br />4 <br />A. The abutting property owners have all indicated that they do not object ti-O <br />the fence as Qonstructed on.the Johnsorl property. I <br />5. The tence as construct ' ed dcms not obstruct visty for traf f 11c at <br />intersection of Mildred,Dr-ivd, and County Road D inasmuch 'as i't is set <br />back approximately 62 feet from the Mildred Drive riqht-of-way line <br />(84 feet from the-pavement) and approximately 21 feet seven inches from <br />the edge of the pavement along County Road D. <br />
