3 December 1980 <br />PLANNING REPORT <br />CASE NUMBER: 1289-80 <br />APPLICANT: Ed Care and sons <br />LOCATION: southwest Corner of County Road D and <br />Evelyn street <br />ACTION REQUESTED: Approval of Prel irainary Plat <br />Variance to Front yard setback <br />PLANNING CONSIDERATIONS: <br />Several years ago , Sam Cave platted the North Boundary Subdivision (of <br />which the subject property is a part) and the subdivision to the west <br />(North Boundary Second Addition) . The property in question and a similar <br />amount of land to the west was reserved for a ponding area which was <br />constructed by the City. The City purchased a drainage easement from <br />Mr. Cave so as to retain the rights to pond water on the property in <br />question and the property immediately to the west. <br />2. This past year, Mr. Cave had a consulting engineer prepare drainage <br />calculations which indicated that not all of the ponding area was <br />necessary. These calculations have been reviewed and approved by the <br />Public Works Department. The analysis indicated that the eastern 70 feet <br />of the property could in fact be developed. Mr. Cave, therefore, proposes <br />to purchase from the City the easement rights for the easterly 70 feet <br />of the three lots proposed for the property, A copy of the proposed plat <br />is attached. <br />3. Also attached is a statement from Mr. Cave indicating the conditions <br />under which he proposes to develop the land. Also attached is a profile <br />drawing indicating the relationship between the land proposed to be <br />developed as it relates to the ponding area to the west. when examining <br />this profile drawing, be aware that the vertical scale is different from <br />the horizontal. This accounts for the odd- looping structure indicated <br />on the 70 foot portion on which homes are proposed to be }wilt. <br />4. You may recall that the rest of the subdivision along Evelyn street platted <br />by Mr. Cave was constructed with the 25 foot front yard rather than the <br />normal. 30 foot required. This was done as an experiment and as a <br />recognition of the fact that the lots are relatively shallow, and there- <br />fore, resulted in a five foot deeper rear yard. Mr. Cave is asking, then, <br />for approval of the preliminary plat and the continuance of the 25 foot <br />front yard policy as previously established on this street. <br />5. we suggest that any approvals granted be conditioned as stipulated in <br />Mr. Cave's letter or as may be amended by the Planning Commission and <br />Council. <br />
