7 July 1982 <br />PLANNING REPORT <br />CASE NW4BER* 1374 -8 <br />ARRLICANT: <br />LOCATION: <br />First Bank System <br />Northerly of the Northwest Corner of <br />Lexington Avenue and Larpenteur Avenue <br />ACTION REQUESTED: Approval of Variance to Setback Requirement <br />PLANNING CONSIDERATIONS <br />1. This application is for the development of another First Bank System <br />"FASTBANK Service" outlet, The location in this -case is as you will note <br />from the attached copy of the site plan is on the east end of the <br />Lexington plaza Shopping Center. <br />This site, as you will recall, is directly north of a recently approved <br />redevelopment for the service station site at the immediate northwest <br />corner of the Lexington and Larpenteur Avenues. You will recall that in <br />the process of reviewing and approving that site redevelopment plan, that <br />the applicant dedicated an additional 16.5 feet of right --of --way for <br />Lexington Avenue, Up until that point in time, the previously acquired <br />r1gh t -of- way was the normal 33 foot (two rod) right-of-way to which the <br />public has rights for roadway purposes on either side of a section line <br />(the center of Lexington Avenue is such a section line) . <br />2* The principal problem with respect to the application for this site is that <br />the owner in this case ( Iry -Margolis et al) are not willing to dedicate the <br />required 16.5 feet on the east side of the shopping center site. The <br />existing 33 foot right -of -way on this section of Lexington Avenue is <br />approximately at the existing curb line., Thus , the dedication of 16.5 feet <br />of right-of-way way would el 31Minate approximately 11 parking spaces on the east <br />side of the property (contiguous to Lexington Avenue) . As in the case of the <br />redevelopment of the service station, City policy requires the dedication of <br />such right -of --way with the consideratLon of Special Use permits, rezonings, <br />or variance approval. <br />3, with respect to the parking, the Center has 51p623 gross square feet of <br />area of which 46,373 square feet is retail space, and 5,250 square feet are <br />restaurant, The required parking stalls equal 295, with 370 spaces being <br />a►vai Table if the proposed structure is built. we have noticed throughout <br />observation that this portion of the parking areas serving the shopping <br />center is much less used than that area in the front (to the south), It <br />would appear . that in terms of a functional location-that the proposed site, <br />discussed at some length with the Staff, appears to be a reasonable one <br />for the purpose intended. <br />
