<br />Dear Mr. Andre:
<br />This office represents Ce 1 is N, Paster, the owner of certain real
<br />property located across Lexington Avenue from the above- described
<br />property. on her behalf, we have received the Notice of Public Hearing
<br />in the above -- entitled matter. For your information and the information
<br />of the Planning commission, please be advised that the First State Bank
<br />of St, Paul entered into a written Lease Agreement with our client on
<br />September 8, 1981, to lease the land at Lexington and Dionne for the
<br />purpose of constructing a detached facility. First State Hank obtained
<br />the approval of the State Banking Commissioner on March 3, 1982 and
<br />the Federal Deposit Insurance Corporation on larch 11, 1982. on
<br />March 5, 1982, however, First State Hank attempted•to exercise an
<br />option to cancel the Lease Agreement. My client refused to a 'ccept
<br />the purported exercise of the option to cancel and has commenced suit
<br />in Ramsey County District Court, File No. 457501 seeking specific
<br />performance of the Lease Agreement. on June 23, 1982, the Honorable
<br />Joseph P. Summers of the Ramsey County District Court took under
<br />advisement any client's Motion for Summary Judgment on specific performance.
<br />We can expect a decision to be rendered within 90 days of that date*
<br />My client is justifiably concerned that the pending actions of the
<br />First Bank System to which First State Bank of St. Paul belong may in
<br />some way impact the pending specific performance matter, Accordingly,
<br />we respectfully request that the .pending lawsuit be brought to the
