The property in question is a 28,620 square foot parcel with 180 feet of <br />frontage on the west side of Cleveland Avenue. The parcel is currently <br />occupied by a single family house which is proposed to he removed. To the <br />north is another existing single family home, To the south and west. Xs a <br />narrow strip of land privately owned that appears to be a remainder from <br />the right -of -way acquisition. To the west and south of. that strip of land <br />is the freeway right -of -way for I -35W. 'phis . marrow strip of land bounding <br />the parcel on the west and the south is undevelopable in and of itself and <br />consists primarily of slope areas. we have asked Dr. Sime to attempt to <br />acquire this additional land so as to increase the potential for his site. <br />He indicates that this has not been possible, <br />2. The property is currently zoned E -4, having been previously zoned Industrial <br />since March of 1959. The Planning Commission and Council's intent via the <br />Comprehensive Plan is, of course, for this area of the city to be developed <br />for business purposes. Dr* Sime proposes to rezone the land to D -3, <br />which zoning category allows an animal hospital as a Special Use. He is <br />therefore applying for the rezoning and the Special Use Permit. <br />3. He proposes to construct a 4,000 square foot building with parking capacity <br />for 20 cars. The building appears to be well planned, attractive, and <br />well sited on the property. <br />The principal problem with the structure is that the land is somewhat <br />underutilized, This condition, however, allows for further expansion <br />inasmuch as there is about 52 feet of land on the lot north of the proposed <br />structure not used in the current development. <br />4. Attached are copies of the site plan, perspective, building plans, and <br />landscape plan. The proposed development conforms to all the zoning and <br />development standards. <br />5, The applicant has also requested relief from the requirement to construct <br />a sidewalk on the frontage along Cleveland Avenue.
