The property in question is occupied by a building owned by the. applicant <br />and leased to mrthwestern Bell Telephone Company* Previously, a portion <br />of the building was used for offices and the remainder was used for storage <br />purposes. The applicant proposes at this time to remodel the warehouse area <br />extensively for of flee purposes o, thus, making the building an office <br />building in its entirety. <br />Attached is a copy of a site plan as submitted by the applicant showing the <br />location of the building and its parking facilities on the lot. The southerly <br />portion of the building is the area to be remodeled for office purposes. <br />2. The problem here is that the building 'is non -eo n f ormI ng inasmuch as the <br />structure is located 30 feet from the south right -of -way line of County <br />Road B-2. The land is zoned "Industrial" which requires a 40 foot front <br />yard setback. Thus, in order to authorize the substantial remodeling of <br />the building, it is necessary to remove the non- confo=ing status by <br />processing a variance to the front yard setback as the building is <br />constructed. Thus, a variance is requested for io feet legalizing the <br />30 foot setback on the front yard as constructed <br />4 + <br />3+ we are not aware as to why the 30 foot setback was allowed in the first <br />place. If the land were rezoned to B -40,'or another business district, the <br />required setback would be 30 feet* As you know, it is the City's policy <br />to encourage land in this area to be redeveloped for business purposes, <br />Thus, it would appear appropriate to approve the ten foot varlance, and thus <br />rem ve the non - conforming status of this structure. The redevelopment of <br />this }wilding for office purposes is in conformance with the City's <br />development policy# making it a business use rather than substantially a <br />warehouse use as it was originally constructed. offices are, of course, <br />a permitted use in the Industrial Zone. <br />
