McCarty who lives at 1894 West County Road C -2 has applied for <br />permission under the shoreline Zoning Ordinance to construct an artificial <br />shoreline c ontiquou s to a portion of the shoreline of Langton Lake on the <br />west side of his property. The proposed construction, if completed, in <br />general will produce a 12 inch high wooden post gall creating a straight <br />shoreline (perpendicular to County Road C -2) and extending the shoreline <br />approximately two feet, six inches, to nine feet westerly into the lake, <br />The construction has begun and was stopped by the City upon complaints <br />issued by neighbors. <br />The construction proposed is prohibited by the shoreline Zoning ordinance <br />but a variance to these regulations can be applied for under section 18.260 <br />of the ordinance. This section of the Ordinance establishes four critiera <br />for consideration in reviewing the proposed variance. <br />It would appear that the council would have the option of turning the <br />proposal down , approving 'it, or may wish to refer the proposal to the <br />Planning Commission for Public Hearing and consideration. <br />We are aware that many of the neighbors are concerned, including some who <br />have had a long time historical interest in the adoption and implementa- <br />tion of the ordinance over the past eight years! Mr. McCarty himself <br />was one of the strong proponents of the ordinance, supporting such <br />legislation to enhance the preservation of Langton Lake. <br />Under these conditions, the establishment of a Public Hearing at the <br />Planning Commission or council level may be an appropriate consideration <br />by the counc i 1. <br />i <br />
